Separated status -Applying Senior or Specilaist work Visa from India

Post by Hannah2403 » Wed Jun 22, 2022 6:32 pm

Hi ,

I am applying for work visa type -Senior or Specialist worker visa through my employer sponsorship. My 7 year old daughter is my dependant along with my application Applying together.we are applying from India.

My marital status is Separated and I am in the process of getting divorce( applied divorce case and is on going in India). Also for my kid I have the parental guardianship issued by court so that I can attach that for her visa stamping.

I have also received COS for my visa application from my employer. Now during my final application review process,I was told that my visa cannot be processed as it may lead to legal issues. Please could you help clarify if there are any issues in proceeding with my application. Thanks

Your standalone application will not refused. I am not an expert at this. If you have got full custody,it should not create a problem but if the other parent has visitation rights then moving would create problem.

Thank you so much for the response on this.

Regarding child custody the other parent has waived off the rights to me solely and there is no mention of visitation in the court order.
Hope there is no legal issues in moving forward.

Thanks

Is the visa review process done in-house by your employer or by external para-legal experts?
Is its internal review then I would not give much weightage
