ILR - long residence - currently in FM 10-year route

Post by shree2022 » Tue Jun 28, 2022 11:06 pm

Dear all,

I arrived to the UK in 2012 and my husband and 3-year old child joined me in 2014. We all have a clean immigration history. In 2021, my child completed 7 years in UK and we were given LTR under FM 10-year parent route. On May 2022, I have completed 10 years of residency in the UK without any break. I have never breached my visa rules. Now I am planning to apply for ILR based on long residence and have a couple of questions here:

1. Whether moving to LTR under FM 10-year parent route would have reset my clock and I have to wait for 10 more years from 2021 to become eligible for ILR?
2. Or I am eligible for apply for ILR in 2022 since I have lived 10 years legally in the UK?

Please clarify. Many thanks.

Thank you, Vinny.

So, the clock is not reset when I moved to FM 10-year since I have stayed legally for 10 years. Am I right? Just to know for sure before I proceed. Fee is a big deal as you know, I don't wanna take any chances. Many thanks.

I think so. 276A
(b) “lawful residence” means residence which is continuous residence pursuant to:
  • (i) existing leave to enter or remain; or

includes any category of leave, etc.
