Student visa

Post by pranee007 » Sat Jul 02, 2022 7:57 am

I got a PG Diploma from Coventry University then I decided to apply for Second Masters.
I applied for 1st covid exceptional assurance on 10th Jan 2022. I got an extension from Coventry university to submit my final project dissertation. I get an extension because my results got delayed. Due to fear of delays in results and visa safety reasons I approached the Coventry university international team as per the advice of the Coventry University international team I applied for a Covid Exceptional assurance visa. Moreover, I got a reply from the Covid exceptional assurance team on 20th Jan 2022, I got confirmation of exceptional assurance till 3rd February 2022.
Then I decided to go back to India before 3rd February 2022 for a few days, I have been suffering from mild covid symptoms. Though I have isolated myself and had proper medications my health condition hasn’t gotten better So I tested for COVID-19 on 02-02-2022 where I tested Positive.
I have tried my best to be back home as I am not able to handle the situation because of COVID-19 all alone but after careful consideration, I have decided to apply for an extension because it would be unsafe to travel due to my sickness. After that I got a Rejection of request for exceptional assurance on 11-02-2022, In that letter, it was mentioned that I should exit the country as soon as possible from that point I started searching flights to India During that time Omicron covid wave was at peak. Only air bubble flights were running from Heathrow to Chennai. I booked the earliest flight which was on 17th February 2022 at 10.00 AM from Heathrow to Chennai. I have travelled within 5 days from which I got a rejected Exceptional Assurance visa.

Then, I applied for a second master's degree in BPP University for July Intake even though I have paid total fees as well but they didn't issue CAS because they are telling me I have overstayed for 6 days. My brother is in UK and he called to BPP london, they are telling like the application is differ to Sept Intake.

What is their concern about the 6-day overstay exactly? It would have no bearing on a new visa application.

I don’t know exactly, my consultancy said that you are overstayed and they didn’t sent to my application to BPP

I think it is worth asking them more about why this 6-day overstay is such a dealbreaker. If necessary you could contact BPP direct to double-check this. It's possible they may have a policy to never sponsor anyone who has overstayed even for 6 days, but that seems odd since given that such an overstay would not impact the visa application in any way. See below.

You did overstay, but only an overstay of 30 days or more blocks you from making a new application. Shorter overstays are disregarded. See paragraph 9.8.5(b) of https://www.gov.uk/guidance/immigration ... or-refusal

You need to ask them. And also ask BPP what their problem is.
