When to Apply FLRM, maximise ILR window

Hi,

brp start 27/10/2020
My spouse arrived in the UK on 29/11/2020
brp expires on 02/08/2023

I know you should earliest 28 days before completing 30 months.
But for ILR to get maximum time to apply for ILR, when is the best time to apply

I think they add 28 days left over from your current spouse visa.


When is the best date to apply anyone can advise and calculate, I want to maximise ILR time window.

Probably after thirty months residence in the UK, between Monday, 29 May 2023 and before expiry of leave to prevent overstaying.

Suggest Wednesday, 5 July 2023 as the optimum date, providing many months to apply for ILR, preferably after completing 60 months and prior to expiry of leave?

I didn't understand that thread you posted, so when is the best time to apply, considering you can get refused.

Is there a possibility to reapply if worst case refused, and when would that be? and is that only if I use priority otherwise the decision would take longer.
my spouses leave expires 2/8/2023

Am I right in thinking as long as the op applies for an extension before the expiry of current visa even if its a day or two earlier they aren't a overstayer as the application was submitted before? How does it work in terms of waiting for a decision?

Once the visa is issued, will it be from the expiry of the previous visa or from when it was issued as in eight weeks from this date? Will this impact ILR application? thanks

I was also thinking of avoiding potential problems with applications’ validity. If an application was invalid, then applying too near the expiry date may leave little or no time to fix any invalidity problems and thus inadvertently overstaying after expiry of leave.

For example, in the times of paper applications, a family of four face removal for failing to tick the box on the form giving authority for the fee to be transferred.

However, this may be less of a problem now when applying in-time online in a right category (such as spouse leave under Appendix FM) where it’s more difficult for an application to be invalid or they may give applicants a chance to fix most invalidity problems.

If there was a valid in-time application, then Section 3C extends leave after expiry to prevent overstaying. They may grant leave from the date of the decision. So, making a valid application shortly before expiry of leave is possible. Waiting times also increases the window of applying for ILR.

Credit Card Statement for Cohabitation

Hi,

Will it be OK to use American Express Credit Card statements for cohabitation evidences for myself and my spouse.

I thought they may not be suitable, as the guidance specify bank statements.

It's the date of entry that is the start of the residence period.

If your spouse meets all the requirements, they can apply for ILR no sooner than within 28 days before 29th November 2025.

I will be applying for my spouse's extension next year. For accommodation, I will be providing a land registry document, letter from homeowner (father), homeowners passport bio page, property inspection report and utility bill.

Will that be enough.

Also is the council tax bill mandatory?

Hi

I will be applying via adequate maintenance, and I wish to use savings as well.
I was wondering, I have a Lloyds bank account, with a classic account, and I have also opened a separate savings account, with the same sort code but its own bank account number.

Lloyds basically allow you to open multiple accounts say a current, one for savings, another for savings etc.

Say I put £5,000 in my savings account, and in my classic account, the balance goes below 0 i.e. -£2000.
Will this impact how many savings they will include from my savings account the home office.

It is the account which you are presenting to HO that matters, remember sort code can be same and that's by bank branch but different account numbers with their separate account statements.
Do remember that relevant savings to be considered is the lowest balance in last 6months not the balance on date of application.

As stated they are 2 independent accounts, decide which statement you are presenting.

For the classic I will be using my income i.e. benefits etc
For the savings, I will have my savings of £k

I will be using statements for both

just wanted to make sure even if the classic account drops to negative it wont be an issue even though its the same bank but separate account.
