Advice for Children travel while application of Naturalization is pending

Post by s_Singh496 » Mon Jul 18, 2022 10:29 pm

Hello Experts,

As said in the Home office portal that we can travel while the application of naturalization is pending. ""Applicants for naturalization as a British citizen can still travel outside of the Common Travel Area whilst their application for naturalization is processing, as long as they continue to have the intention of settling in the UK""

Now, for the kid's case, (under 3 yrs in my case) who are born in the UK and are applying need not attend the oath ceremony. However, this is where the confusion starts.
Let's say we are traveling for 1-2 weeks and my child's application is approved in that period itself  and given the child need not take the oath ceremony, I guess the certificate itself will make the child a UK citizen. In this case, if we are abroad then can we return back (Given she has a valid ILR visa) ? If not, then how can I travel with her while her application is pending?

Thanks in advance.

""Applicants for naturalization as a British citizen can still travel outside of the Common Travel Area whilst their application for naturalization is processing, as long as they continue to have the intention of settling in the UK""Yep, free to travel.

Now, for the kid's case, (under 3 yrs in my case) who are born in the UK and are applying need not attend the oath ceremony. However, this is where the confusion starts.

In this case, if we are abroad then can we return backYes, you can return. The airline just needs to see that child has a valid permission (ILR) to enter the UK. (Given she has a valid ILR visa) ? If not, then how can I travel with her while her application is pending?

Thanks in advance.

@ticktack thanks for the confirmation.

Now the reason for this post or the confusion is because:

1. Child need not attend the oath ceremony; when the naturalization certificate comes, it means the child becomes a British citizen, and to travel further child needs a British passport.

So, will it not be a problem when the certificate of naturalization comes while the child is out of country ? Because immigration status will not be affected while your application is being processed but as the certificate comes immigration status will be changed and will the child be allowed to enter ?

In the case of adults, it's okay as even after the certificate, one has to take the oath ceremony for becoming a British citizen, so they can travel even though the certificate came while they are away.

So, will it not be a problem when the certificate of naturalization comes while the child is out of country ? Because immigration status will not be affected while your application is being processed but as the certificate comes immigration status will be changed and will the child be allowed to enter ? Not a problem as the child is out of country and has a valid BRP to allow re-entry to the UK. The problem here is the airlines and not the UK immigration. The airline would carry you or anyone that has a valid visa to the UK.

In the case of adults, it's okay as even after the certificate,Nope, no certificate till you take the Oath/ affirm your allegiance. one has to take the oath ceremony for becoming a British citizen, so they can travel even though the certificate came while they are away.Approval, not cert.!

@ticktack

thanks for the prompt response.

So, the child's BRP will be valid even though the Child got the certificate approved (while child was away from the UK) ?
