Hi everyone,
I have presettled status for being married to an EU person.
I applied for settled status but i made a mistake as I do not have 5 years with my eu partner. I have 4 years and 3 months.
When i applied online i automatically was given settled status so i was tempted to apply. but i do not think i have 5 years continuous residence.
I have called the resolution centre to cancel my application and they said the caseworker will be in touch to do that.
Would they cancel my application? and Can i apply next year?
Any input is appreciated.
If you completely forgot about this and did nothing, two things might happen:
1. If by the time they consider your application the 5 years have not passed, the caseworker will give you Pre-settled status again, which pretty much amounts to extending the validity of your pre-Settled status. You won't lose any accrued time, this would NOT mean you have to wait another five years to apply for Settled status. It would only mean that your Pre-settled status will be valid for longer.
2. If by the time they consider your application the 5 years have passed, then you will be granted Settled Status.
You can apply later as many times as you want. There is no reason for you to be asking to cancel anything. You can't lose either way. You are overthinking this.
