Spouse Visa FLRM Extension application query

Dear Members,

My wife's FLRM 2.5 years visa due for renewal but we have some queries if moderate please advice on this.
Background: After getting my ILR in 2019 through SETLR, we have switched her visa category from PBS dependent to Spouse visa

1) We have 07 months old baby and i am in process to apply for his 1st British passport, Do we need to include him in this extension application; all we have his Birth certificate at the moment

2) my wife is on maternity leave since Nov 2021; She's salary is £21K but she has been receiving SMP pay only since nov 2021.
Can we count her SMP maternity pay to meet finance requirement ? what is total income requires Is £18600 or £22,400 because of baby.

3) Total income she received in last 12 months (July 21 -June 22) = (July to Sep: 1750 x 3= 5250 including part furlough, Oct:1750 basic pay, Nov to June: 1557 + 1035 +673 +607+673 +671 + 693+671 = 6580
LAST 12 MONTHS TOTAL INCOME = 13,580
Will this works to meet the criteria ? Do they count £21000 as per the job contract or the actual net income ?

4) How much is the fees for priority service £500 or £800 ?

1) If baby was born in the UK, then no.

2) There is no extra income required for a British baby. Only £18600 required.

Hi Vinny

Thank your response, just reading though the guidance about maternity leave.

As per the guidance understood that we can provide 06 months payslips for the period before the maternity started in our case that will be April to Oct. Please correct me if i am wrong.

How about the furlough payments e.g.some payslip shows furlough payment like 70% furlough + 30% employer
Will that be okay ?

Changes to the minimum income and adequate maintenance requirement

If you’ve experienced a loss of income due to coronavirus up to 31 October 2021, we will consider employment income for the period immediately before the loss of income, provided the minimum income requirement was met for at least 6 months immediately before the date the income was lost.

If your salary was reduced because you were furloughed we will take account of your income as though you’re earning 100% of your salary.

If you’re self-employed, a loss of annual income due to coronavirus between 1 March 2020 and 31 October 2021 will usually be disregarded, along with the impact on employment income from the same period for future applications.

The concessions have not been extended beyond 31 October 2021. Any income loss after this date will not be taken into account within the financial concessions listed above and applicants will be expected to meet minimum income and adequate maintenance requirements as per pre-pandemic levels.

Use last 6 payslips prior before she went on maternity.

Dear members,

Just realized that mrs visa already expired 14th July, i am still in process to gathering documents..What shall i do ? it appears earliest i can submit on 23rd July so it will be 07 days overstays. Will that be a problem anywhere now and in future application ?

I am filling up application form and asking evidance for not applying on time? What shall i mationed as it just happened and we forgot about expiry by thinking end of july.

Dear Members,

We are showing her income for period 1st may 21 to Oct 21 (06 months) before she went on maternity leave. Now the application not submitted yet and she is overstayed by 08-09 days and her employment still secured but Is this situation will create any issue because of her visa expiry ?

I am filling up application form and asking for evidence for not applying on time? What reason shall i mention as it just happened and we forgot about expiry by thinking end of July plus had a covid plus we have 08 months old baby hectic tight schedule.

I am just preparing application for my mrs, noted that i need to upload ECctis letter to confirm qualification meets the standard.

I had intend to upload uk naric as i did with previous intial application. Can somebody please advise on this ?

Its same, your NARIC could be used again no problem at all. If I am not mistaken.

Is there any other way i can pay IHS ?

You have to wait my friend and regarding your other query, no one can tell you weather your application will be successful or not I am afraid,it all depends on case worker, plus it will be better and in your favour if you provide a good solid reason for late application.

Cover letter explaining the reason for late application (gp could not provide any letter so just self explanations)
Passports, brp etc..
tenancies, ref. landlord
payslips for period before the commencement of maternity leave April to oct (relying on this to meet financial requirements)
bank statements April to oct
payslips till date (maternity payments) and bank statements till dated
p60 year 2022
employment contract 2019
baby birth certificate
Address documents bank letters, voting poll cards, driving license etc.. period 2020 to till dated in gap of 3-4 months for Both
Please advice if we are missing anything to upload, paid for biometric appointment on 8Aug and super priority service service for application.

Thank you. Just noticed you recently got success with you extension. I want to ask about biometric appointment we have scheduled on 08th and purchased extra documents check service.

Does she need my ori. Passport during appointment ?
I made my child’s passport application and have to send it to passport office.

What will be deadline to upload all these docs ? I have almost uploaded everything but Can I remove and reupload again if i want yo upload more or remove some.

If you have purchased documents scanning and upload service then you don’t need to self upload them. And original passports are required at the time of appointment.
I will repeat if you have purchased documents scanning and upload service then you don’t need to upload them. They will get upload at the time of appointment. And if you haven’t purchased this extra service then you have to upload them before your biometric appointment, and I am not sure if you are allowed to change or replace any document once its been uploaded.

I have uploaded almost everything by myself i have bought extra documents checking service not upload.
Does that mean i can upload more documents until 02 days before my biometric ?

Also i just noticed box on uncvas portal asking to tick to confirm i have uploaded everything? Do i need to click that now to finish the application or application already submitted?? Just doubt in my mind as the application is already late.

Best is to check with UKVAS, as they are the service providers. And will suggest you to fully read your email which UKVAS had sent your when you have purchased an extra service.
