Tier 1 visa - solicitor has disappeared

Tier 1 visa - solicitor has disappeared

One of my friend who is currently on student visa in UK, expiring in January 2009, submitted all her documents including passport to a solicitor so that he can prepare the case and submit the application to the home office. She also paid the full solicitor's fee. She was assured by solicitor that her application will be posted to home office before her birthday which was due in few days so that she can claim maximum points for age. This was the only way she can be approved for TIER 1.

To claim maximum point to be approved, application should have been on case worker's table before her birthday. She waited couple of days for home office to charge her card for application fee but it was not chrged. She contacted the solicitor and was told that her application couldn't be submitted on time becuase of solicitor's personal circumstances (family member funeral overseas). She has missed deadline to claim points for age. Solicitor said that he will help her and will write a supporting note along with application to explain why her application wasn't submitted before the due date to claim points for age.

2 weeks have past but her application is still not forwarded to the home office. She is trying to contact the solicitor but he is not contactable. Receptionist on the phone says that he is not available without giving any reason.

Her worry is that she can't be approved on Tier 1 anymore because of the delay by solicitor not through her fault. She has already paid the full fee, her passport and other documents are still with solicitor and her current visa is expiring in January.

Any suggestions where she stands and what steps she should take to resolve this matter?

I dont understand how come her file was not given to another solicitor to do and why isn't it be done by someone else now?

very sad to hear that. there are some stupid people out there , advertising themselves as "solicitor" or immigration specialist"...

i have seen 1 or 2 on gumtree websites....they dont have a clue..what they are talking....

anyway...you cant file a case aginst them becuase of your immigration issue...ok...tell us what is the solicitor name then ?

I would go there if I were her and just pull her application, retrieve her passport and documents. Cut her losses at this point, she can go after the solicitor fee later (he after all admits he didn't file her application) but for now it's more important that she gets all her papers so she can work on the application herself. I'm sorry to hear that her birthday has passed, but maybe she can explain the situation to the Home Office?

Is the "sollicitor" registered with the OISC or the law society?

No, the solicitor is not OISC registered.

I beleive a Tier1 (Highly Skilled MP) candidate should prepare and file his/her application own.

Solicitor charge very huge sum for merely filling the forms.
