ILR when can I apply

Hi moderators, hi all

I am aware this has been asked several times but to ensure my understanding is correct and current, asking here.

I am on skilled worker visa due to complete 5 years in March 2023. When does the 28 days (for application) prior to completing 5years count from?

Visa approval letter: 6 March
BRP issued: 13 March
Vignette valid from: 19 March
Date of first entry on this visa in the UK: 26 Mar.

Can you clarify the exact date based in above when can apply for ILR?

If your visas was approved in 2018 this will be around 6th March 2023

Hi all,
Happy New Year.
Reiterating my query below
1)When is the earliest date (28 days prior to completion of qualifying period) I can apply for ILR via 5 year skilled worker visa route.

The approval dates for my initial visa as follows:
Visa approval letter: 6 March 2018
BRP issued: 13 March 2018
Entry clearance/vignette valid from: 19 March 2018
Date of first entry on this visa in the UK: 26 Mar 2018

2) Do the documents for the ILR have to be dated within 31 days of the ILR application date (online submission) or biometric date?

Your response in this matter will be highly appreciated.

For settlement application, is it required to again submit the evidence of English language if this requirement was met in a previous skilled worker/T2 general application?

Dependents visa after main gets ILR

Hi All,

I have few queries with respect to modalities of ILR application, skilled worker route:

1. I know dependents can apply with the main applicant in the same application form having completed 5 years in the UK.
However, is it possible that main applicant apply first and dependents apply immediately after the main gets ILR (via super priority)?
Will the dependents remaining leave as dependent of skilled worker gets invalidated as soon as the main gets ILR?

2. English language proof: I have UK NARIC statements from 2017 (AQUALS and EL proficiency) which was done at the time of skilled worker visa.
Can I use the same statement for my ILR or need to apply for a fresh assessment for ILR.

Home address

Hello,
When I moved my home, updated my address to the UKVI.

Home address given in the update was with “county” mentioned on it.
While all other proofs do not mention “county” in in the home address.
Rest all other details are exactly the same.

Which address should I use for the ILR application?
Address with county on it or without?

Hello,

I have a query regarding ‘place of birth’ for the ILR application.
Previous passport, valid BRP and Life in UK test (Id used BRP) have -Place of birth mentioned as: Town only (xx)
All the previous visa applications were made based on the previous passport and hence HO has place of birth: Town in records.

I updated the passport, realised the passport issuing authority included under my place of birth also the state with name of town
I.e Town, State (xx, yy)

What should I input now in the ILR application ?
Should it match with the current passport?
It does not however match with the current BRP which was issued 5 years ago based on the old passport.

Kindly help.

Can you please point me to guidance text where this is written?
I am aware for the skilled worker main appoint there is a text which states” the time between issue of entry clearance and entry into the UK counts towards to continuous residence” but could not find a concrete one the dependents.

Counting the continuous residence period
Where a person is applying for settlement as soon as they qualify you will need to
calculate their period of continuous residence.....
...... you must establish the date the applicant was granted entry
clearance. The time between the grant of entry clearance and the date of arrival is a
period during which they had permission on that route and should be treated as a
period of lawful residence. In these instances, you must establish the date the
applicant entered the UK. The time between the grant of entry clearance and the
date they entered the UK counts towards the total of absences.
