ILR and Dependency Visa

Hi there,

I will be eligible for ILR application in November 2022 (5 years on tier 2 visa). My wife has been on a dependency visa for the past 2 years.

I would like to ask for advice for my wife, would it be better for her to:
1. Go on a dependency visa as I get ILR
2. Go on a Tier 2 visa herself (as she is currently working and would be able to get certificate for sponsorship from her employer)

Which would be a better option for her to apply for ILR in another 3 years' time?

1. Go on a dependency visa as I get ILR
She continues to extend her PBS Dependent visa (a 3 year extension) until she qualifies for ILR as a PBS Dependent on form Set(O)
2. Go on a Tier 2 visa herself (as she is currently working and would be able to get certificate for sponsorship from her employer)
This resets her 5 year ILR clock to zero. She cannot combine dependent visa time with main skilled worker time to make up 5 years for ILR.

Hi there,

I will be completing my 5 years Tier 2 visa in 26 November 2022 and my Tier 2 visa expires on 9th December 2022.

I will be applying for ILR 28 days prior to the expiry date. I was wondering when can my wife apply for her dependency visa - is it together with my application or only after I get mine approved?

Together, different applications obviously or the latest before dependent visas expire.

The dependent visas will only be considered if your ILR is approved.

I was trying to prepare my wife's application as a Dependant Partner visa in view of applying my ILR in 1 month's time.

It seems that I'm only eligible to start the application for my wife once I get my ILR gets approved. Is that right?

Is there a way to apply for it concurrently as I'm afraid the ILR can take awhile and my wife's current dependency visa will expire within that period.

It is a 3 year extension. You cannot choose a lesser time.

Correct yes for IHS. The visa fee is £719, not £704.

The biometric enrollment fee varies depending on appointments available at ukcvas.

Hi there,

I have just applied for my wife's application based on the 'extend Skilled Worker visa as your partner' (https://www.gov.uk/skilled-worker-visa/ ... d-children).

After following through the application, I was brought to scan the BRP using the app and fill up the forms. With regards to the payment, I was only asked to pay £247 for standard service (there was no priority or super priority option). There was also no IHS surcharge.

I'm a bit worried if this is the right application?

Hi there,

I was just wondering if I can get some advise regarding the application for my wife's PBS extension visa.

My wife has been on PBS Dependency Tier 2 Visa for the past 3 years. I have recently received my ILR and put in an application for her for an extension of PBS Dependency Visa using the link 'extend or switch to your Skilled Worker visa as your partner' (https://www.gov.uk/skilled-worker-visa/ ... d-children).

After going through the form, I was only made to pay £247 for normal service (there was no priority service and no further charge for IHS). How do I check if this is right? The automated application form shows: TYPE OF VISA/APPLICATION: Dependant Partner.

Hi there,

My wife's PBS dependency visa expires on 9th December 2022. I have applied for the extension based on my ILR.

What happens if the visa is refused after this date as I applied for her on 29th October 2022 (Results usually within 8 weeks). Is there a grace period after that to reapply?

As there is no clear guidance on the Home Office site the incorrect IHS payments seem to be a relatively common issue. In my case on the last day of the 8 week SLA earlier this week I got a request for an IHS top up for the value of 6 months as I’d used the wrong date (although someone else on this forum has done the same and still received the visa!) now waiting to see if that reset the clock by another 8 weeks!

You do not have time to play around due to impending expiration of current leave.
Pay for new application and ask for refund of previous.

Hi there,

This is a summary of my issue:

28/10/22: Received my ILR
29/10/22: Application for my wife's dependency visa extension

28/11/22: Received an email stating I have paid the incorrect fees (I'm working with NHS and there is apparently a waiver fee for IHS). However, during the application, there is not any option to choose the fee.
I emailed them stating the situation, and within the same day, I received an email from UKVI NHS team stating that there was confusion on their end, and the visa has been granted and the fees were indeed correctly paid

28/12/22: Received the same generic email stating the incorrect fees has been paid - I need to reapply within 10 days etc.

What shall I do now? It's obviously an error and I like everybody else can't get hold of them via telephone. I have emailed them but the waiting game is very stressful.
