Hello everyone,
I applied for citizenship ( jan 2018 ) and I have been refused due to good character. It say I have been overstay and working. Between April 2010 to dec 2011.

1)Working and holiday visa - april 2008 - april 2010 ( expired)
2)Married to eea family member. dec 2011. Resident approve June 2012.
3) permanent resident card received (July 2017)
4) apply citizenship 2018 refused reason overstay and working April 2010 - Dec 2011
5) settle status ( 2019 )

My question is when I can apply for citizenship from the date of my married to eea family member or when I received my eea resident card. Regarding 10years good character. ( December 2021 or June 2022 )

your legal status will consider from date of your marriage with EEA, not the date when you got residence card. you have to be show good character requirement 10 years from the date of marriage untill the date of Naturalisation application. just make sure you did not got deception from the previous Naturalisation application.

Tthia is Back to 2018.I have received letter from home office the reason your I have been refused.
You were in the uk without valid leave between April 2010 when you visa expired and December 2011 when you married you partner. You were not therefore compliant with uk immigration laws during this period.

You have admitted on your form that you were working without permission as your visa only permitted working for up to 12 months. Your application has therefore been refused.

It’s open to you to re-apply citizenship at any time but an application made before December 2021 is unlikely to succeed.

perfect , its clearly mention in your refusal aswell, now you can apply at any time. you are complying good character requirement.

Hi,my visa is valid for two years so I can only work one year and another year is for holiday.I actually work every weekend and bank holiday through these two years. And I thought I only work no more than 365 days I should be fine for this visa.but when I apply naturalisation I did fill I’m work through these two years and I got rejected. Ho Said I should not work for two years because my visa allow me to work for only a year. I did appeal for the decision but ho not accept what I explain to them.it said I admitted working these two year. When I apply for naturalisation i didn’t explain that. That’s why got rejected.

Can I just ask, did anyone receive an e-mail regarding refusal or just a letter? I e-mailed citizenship e-mail and they told me a decision has been made but I did not receive an e-mail the same as my partner (which was an invitation to book oathtaking). Has anyone ever received a refusal e-mail? Thanks.

Yes, this is definitely an error. However, I am not sure whether its a Police records error or Home office checking error. I'll wait for my SAR to return, then take from there.

Why SAR? that takes 40 days. Do a Police check as that will show your criminal history if you have any and it comes within 1 or 2 weeks. don't leave it too long. For any criminal history check, you can simply do a CRB check.

Just a quick update. I received my SAR from ACRO, and they confirmed that there is no trace/data held about me on the Police National Computer.

So, I'm about to complete an application for reconsideration.

This whole process is frustrating....and expensive.

Approval letter received 14/05/2022 ( Dated 04/05/2022)

Thank you for sharing your experience, I applied for reconsideration and I noticed a refund of 292£, but I didn't hear anything from the office it's been two weeks ? did you received the outcome straight away or the letter date was old ?

I believe it is different from a manger cause worker to other.
they are working very slow now, they refunded the 292 on 5th July and I received a confirmation on 2 August.
keep your eyes on your bank account for any potential refund.

the original application was submitted on June 2020, refused on August 2022.
the reconsideration was
submitted on15th May 2022,
they collected the fee on 7th June 2022
I noticed a refund of 292£ on 5th July 2022
Received the confirmation on 2nd August 2022.
by the time I was waiting the confirmation, the local Council received my certificate only a week after the refund.
I hope you receive a positive results soon.

yes, I applied through a solicitor if you paid by debit or Credit card you will receive a refund of 292£ on your bank account, however if you paid by voucher or other Methods your solicitor will receive a cheque of 292 by post.
Usually it takes time and you will be able to know the outcome if you receive a refund to your bank account even before the solicitors knowing anything.
the final decision letter will be sent to your solicitor.

Hi Everyone
This is to update my situation. After 8 years finally my naturalisation reconsideration was successful and had a letter from the HO that I need to attended a ceremony. I applied for citizenship on 2015 and the HO refused my application based on good character. 3 times I applied for JR and finally after 8 years the HO decided to grant me citizenship.

My 4 children were refused registration last year . i appealed for 2 of them and got their certificate and approval .

I have decided to appeal ( review) for the other 2 children however it is now 5 months with no reply.

Is there a specific time that they must reply to the Review?

Can they take more than 6 months? and if yes is it common?

For nationality there's only "reconsideration", which is not an immigration appeal.
If you consider UKVI have not properly applied the relevant law and regulations.
There's no service target for these, it can take as long as they take.
