Child Benefits

There are mix advices on forums please clarify

i am BC my son is on family route with NRPF . i would like to know whether i can apply for child benefits.

i have read its the parent who claim not the child. also they already passed 5 year of maintenance condition she is on 7th year continues living

From a Benefit calculator
If you have Limited Leave to Remain or Enter you usually have no recourse to public funds. This means that you cannot claim most benefits, or have someone else's benefit claim increased to cover you. If a claim is made it may affect your right to remain in the UK.

There are special rules which apply when working out how much benefits a household can get if anyone in the household has limited leave to remain. Our calculator cannot apply those rules, so you cannot use the calculator to get an accurate or useful calculation of your benefit entitlement.

You should seek specialist advice before trying to claim benefits if you, your partner or your child have Limited Leave to Enter or Remain.

Child Benefit

Eligibility for Child Benefit depends on the parent’s immigration and residence status, rather than the child's nationality or immigration status.

An eligible parent may claim Child Benefit regardless of the child’s immigration status. However, when a child has leave to remain with NRPF, legal advice should be obtained from an immigration adviser before an application for Child Benefit is made to find out whether this may adversely affect the child’s current or future immigration position.

When a sole parent or both parents in a household have leave to remain with NRPF, they will not qualify for Child Benefit and will not be able to claim this for a British child. The parent may only be able to claim Child Benefit if an exception applies, such as due to a reciprocal social security agreement that their country of nationality has with the UK.
