visa for dependents

Post by pra1980 » Sun May 14, 2023 11:18 am

Hi All,

I am going to apply for endorsement using Route 4. I have already spent 1 year in the UK in Tier 2 visa. I know that I will get ILR in 2 years. I would like to know what is the minimum many years I should apply for my dependents. Shall I apply for 3 years or 5 years?

Regards
Pratap

Your dependents will get a visa with the same duration as you. They can't apply for less or more time as the main PBS migrant.

Route 4: Peer review

Post by pra1980 » Tue Aug 01, 2023 6:17 pm

Hi,

I am on a Tier 2 general visa until Jan 2025 since last year. My family has a dependent visa. I would like to apply for GTV using Route 4. I would like to know whether I should apply for GTV 3 years for me and 3 years for my family. If I am granted vGTV, does it mean I can get ILR. When will my family get ILR. Please guide me.

Regards
P

Your dependents need 5 years residence as PBS Dependents before they can apply for ILR.

Does it mean that I have to apply for 3 years of GTV and 5 years for my dependent? Please let me know.

I did not say that. They simply need 5 years on a PBS Dependent visa to qualify for ILR.

You have also already been advised that you cannot apply for a different visa duration for them. They get the same visa validity as you.

Can I apply GTV dependent visa for 3 years for my family and extend their visa for another 2 years as ILR dependent? Is this possible?

If you switch their visa category after you get ILR, it resets their ILR clock to zero and a new 5 year route to ILR (2 x 2.5 year visas).

Once you have ILR and before their visas expire, you simply extend their PBS dependent visas for another 2 years.

What visa do they currently hold and how long have they been in the UK?

They currently hold PBS - Tier 2 general and they came here last year. Their three visa is valid until Jan 2025

To avoid any confusion, let me write below what I understand I need to do based on your suggestion.

I will apply for my GTV now for 3 years, based on this I will get my ILR by June 2025. I ask my family to apply for their visa as GTV dependent for three years. This means that they will have a dependent visa until October 2026. By this time they would have spent 4 years and 4 months as my dependent. What you are asking me to do is to apply for their extension before I get my ILR i.e. before June 2025 My question is it possible to extend their visa as GTV dependent for another 3 years which is until June 2028 ?

or shall I apply for GTV for 5 years for both me and my family ? What do you suggest ?

Correct.

I did clearly state that "after you get ILR and before their visas expire"! If you apply for an extension BEFORE you get ILR, they will NOT get an extension that is dated after your visa expiry. So you need to plan accordingly. A PBS Dependent cannot have a visa that is valid for longer than the main PBS visa holder.

Your choice.

Note that visa and IHS fees are increasing soon.

Sorry to come back late on this. I am quite clear on what I need to do.

Apply for my GTV now and get ILR by June 2025. My family has got a visa Tier 2 dependent visa until July 2025. I can apply for their extension as GTV dependent by April 2025 (before I get ILR) and get it for 3 years. This means that they will have a visa until April 2028. By July 2027 they will get ILR.

Please confirm if you see any obvious issues in doing this.
