When to apply?

Hello!

I have just received my ILR BRP (SET(M)) and because I am on spouse route I technically could apply for naturalisation now but I am not meeting the 90 days rule right now.

I have also read somewhere that if there is a 180 days absence in any 12 months period, this might be a problem?

If I share my absence history, could you kindly let me know if there is an issue?

Please kindly reconfirm if first and last days are not to be counted?

01.07.2020 - 09.08.2020 - 38 days
05.09.2020 - 08.09.2020 - 2 days
12.12.2021 - 02.04.2022 - 110 days - (I was on maternity leave)
29.06.2022 - 11.09.2022 - 73 days - (again on maternity leave)
01.02.2023 - 13.02.2022 - 11 days
14.02.2023 - 17.02.2023 - 2 days
20.03.2023 - 04.04.2023 - 14 days

Total of 250 days in 3 years and 100 days in 12 month.

In 2022 I basically passed 180 days in 12 months period. Is that a problem?

If I apply on August 10th (I am considering this day because the rule says that I had to be in the UK on that day 3 years ago) will that be ok? I am asking because last summer I was away and not sure how will they calculate that?

Has anyone applied with more than 90 days absence in the last 12 months?

I have been away exactly 100 days in the past 12 months. I know the rule says that absences up until 100 days will be disregarded but do you have an experience with that?

Do I need to provide an explanation or a cover letter?

Are you including the days of departure in the UK and/or the days you arrived back? If so, these aren't counted as absence days.

No, I have not included first and last days (travel days). It’s 100 actual days away

To be safe, wait till 12.09.2023. Less than 3 months away.
No sin in failing, you just have to try and try again!
