Help required please: BC application

Post by Chilli_garlicsauce » Sat Jun 10, 2023 5:21 pm

Hello everyone,

I have a question regarding my cousin’s citizenship application. He was questioned by the police because his phone number was found on a cannabis dealer’s phone. They asked him how he knew that person, what he looks like etc to which he responded truthfully - no warning, charges or penalty tickets were issued apart from a simple thank you.

Does he need to declare this incident particularly when answering the good character requirement questions? This was 5 months ago and he has stopped using cannabis completely.

Any help would be highly appreciated!!!

As he’s not been charged or found guilty of an offence there’s nothing to disclose as far as I understand.

Thank you so much. The officer did take his personal details though including his phone number. Is that going to be a problem?

Having your phone number in a drug dealers phone and using drugs, they are not exactly chargeable offences. Nothing was caught on his person.
Being a user isn't a crime.

He can relax and stay away from drugs. Get him some help if it's required.

Hello again everyone, my cousin is ready to submit his application today and he has answered ‘No’ to the question which asks if there’s anything about his character or behaviour that he would like to share with the Home Office.

Could someone please confirm if answering ‘No’ is OK?

Thank you so much in advance! :)

If there's nothing to share then surely NO should be the answer.
It's not a trick question.

Nothing apart from what I have mentioned in the original post. No charges, cautions, warnings, reprimands or anything of that sort. We are just thinking if using cannabis a couple of times in the past renders you as a person of bad character or not?

He was not charged or convicted of anything.

Why would you want to disclose information that are not required. You will be asking for scrutiny.

Hello again, just a quick update.

The applicant received the ‘exceptionally complex’ email last week. Do you think it could be due to the aforementioned issue in the original post? Is there anything that had to be declared when answering the ‘activities regarding good character’ question?

Please do let us know. Many thanks!

It may and it may not. No one on here can give an exact answer to that.

Most likely it could be. Everything is checked with the police. His name could easily have been flagged up. Processing "might" be longer than usual.
They have to satisfy themselves of who and what he is.

Once they're satisfied beyond reasonable doubt that he has no case to answer, it would be approved.

You can't walk in the rain and expect not to get wet. Extra checks are part of the consequences unfortunately.

Thank you all. He did call the police officer who visited him asking him if he was in any sort of troube to which the office responded, ‘No, not at all’.

The applicant has no convictions, warnings or anything. No adverse DVLA record, perfect credit score, has always paid council tax on time and nothing else that could cause an issue.

All that doesn't mean that the HO doesn't need to satisfy themselves, before making a decision that can't be easily reversed. He just needs to wait and trust the process.

So are you implying that they are probably assessing the case more rigourously in order to satify themselves? Do you think if they wanted to refuse the application, they would hav done that without asking for more time?

In other words, if it’s guaranteed to be a refusal shall we withdraw the application and not worry about it all for a few years?

I'm merely answering your question on what ‘exceptionally complex’ might mean for him. Do you think if they wanted to refuse the application, they would hav done that without asking for more time? A high possibility.

In other words, if it’s guaranteed to be a refusal shall we withdraw the application and not worry about it all for a few years? You could still face the same situation then. Better to let things flow as they are already and see where the road lead you. What's going on in the background doesn't bother him from his day to day. He can work and he can travel as normal.

Just remember, if you withdraw an application now the fee will be lost - so best not to panic and see what happens. We all have been through this process and know how agonising the wait can be.

We are worried about the HO alleging the applicant of deception as the incident was never mentioned on the application form.
