Can we skip 15 days income in the last 12 mnts earnings?

Hi Seniors,
I'm planning to apply for Tier 1 visa in the 1st week of jan'2009.I'm currently with company A (joined on 16 Feb 2008) Before that I was with company B. I do not have salary slip for the period 01-Feb to 16-Feb2008. I've final settlement sheet for that period which has negative income of arround INR 9k. I do have salary slip for the rest of the period for the month of Feb'2008 (Which is from my current organization).please see below details

- I was supposed to give 60 days notice for release from my previous organization.but I gave 44 days notice. I had 8 vacation leaves which were adjusted with the notice and I was eligible for pay just for 6 days (14 worked days - 8 notice period short fall)

- Out of this 6 days, my eligible salary was X amount and TDS (outstanding tax for the year) 2X. So I had to pay 2X - X = X amount.

- That is, my income was negative for that 14 days period.

- In my settlement sheet all these components are mentioned. but there is no column which reads 'Gross Salary' instead it reads 'Salary'.

- Since there was no positive salary for that period, I have no credits to my bank account from company B for that period.

- I do have salary slip for the month of Jan2008 from company B and salary slip for the period 18-Feb-2009 till 29-Feb-2008.


My query is can I skip that period income in my previous earnings claim, and just claim for the rest of the period (current organization) ? Can we skip the income for 15 days in the last 12 months earnings?


So my claim would be as below:

Company Y:

from 01-Jan-2008 to 31-Jan-2008

Company Y:

from 18-Feb-2008 to 31-Dec-2008


Is this allowed? Do I have to attach the settlement sheet aswell even though I dont want to claim that period earnings?

Please help. Thanks in advance.

dilip... as far as i understand in Tier1 you can need to 12months of earnings in the last 15months.. so "i think" you can skip the month Feb 08.. but if u r admant to use the 15days of Feb also.. read through the rules or search the board again or wait for some expert/senior on the board to respond...

Thanks Ramesh. Well I want to claim Jan2008 earnings as well as 15 days earnings for the month of Feb'2008. Is this allowed.
