General employment permit refused

Ho everyone,

I recently got an offer to work as a lecturer in Ireland. My job is in the Critical Skills Occupations List (Soc4 2311).

However, as I received my phd degree less than 2 years ago. I am not eligible for the critical employment permit.

HR advised me to apply for a general employment permit.

Today, I received the refuse letter from DETE saying that my job is not in the critical skills occupations list and thus they require the labour market needs test which I do not have.

However, my job is in the critical list. I am not sure why they refuse my application.

Could you please let me know? Should I submit a review of decisions form?

I wouldn't say your job is on the list. Job on the list is "lecturer who has a PhD for 2+ years"; you don't, hence your specific job isn't on the list for employment permit purposes, otherwise you'd gone for CSEP.
As you're trying to get General Employment Permit, the criteria for it include Labour Market Needs test.

For me that makes sense - you satisfy criteria for neither CSEP nor GEP at the moment (either missing 2 years or LMNT).

Have you looked at hosting agreement?

Thanks for your information.

Is hosting agreement applicable for lecturers/assistant professors with teaching, research, and admin duties?

If this hosting agreement does not work, can I wait until I hold my phd for 2 years (on February 2024) and apply for the critical work permit?

I am a bit confuse now and do not know what are my options. Tried to contact HR but no response yet.

It's aimed at researchers mostly, but depends on your duties I guess - check with HR in university.

Technically, nothing stops you from that. I don't know if university that offered you the job is ready to wait that long, though (processes may take 6+ months for permit + visa, assuming you're a visa required national).
