HSMP extension into Tier 1 (General)

Original application for extension submitted 7 Jan, called by UKBA on 14 Jan to say my application form had been updated and I was using the wrong version (I downloaded it back in November and filled it in). So had to wait for them to send everything back and re-submit (money was refunded), so had to start again.

Application Sent: 19 Jan (non-JR)
Fee debited: 21 Jan; Ref letter received 23 Jan
Urgent request sent: 29 Jan
Holiday booked: 13 Feb - urgent request not actioned, had to cancel holiday
Status as of 3 March - Awaiting consideration

Have another holiday booked for 3 April, hopefully I dont have to cancel this one too.

UKBA response when I asked them when will I know when a decision has been reached and my passport sent back "When Royal mail deliver it through your door" . Very frustrating..

Having spent the entire day criticising the home office, I was delighted to get home and find that my documents have been sent back to me with my application approved and passport stamped accordingly. I am so relieved!

Thanks to all that have helped me and supported me through the process, especially push_hsmp and tvn_ramesh amongst many others!

Visa duration (non-JR)

I have a query. When Home Office extends the visa under tier-1 non-JR category, do they extend it for 3 yrs, or for more than 3 yrs such that the person can apply for ILR ? I mean, my visa date was from 30th Jan'2007 to 30th Jan'2009. I entered UK on 18th Feb'2007. So, now, when they extend the visa, will it be valid till 30th Jan 2012 or till 18th Feb 2012 ?

Say, the ILR rules do not change, and if one is eligible to apply for ILR after 5 yrs, then in my case, if they give me visa till 30th Jan 2012, then can I still file for ILR or do I need to file tier-1 extension again?

I had sent the extension application on 10th Jan. Last friday (27 Feb) I called them up and they said its being looked at by the caseworker and is awaiting consideration. I called up today (5-Mar), still the same status. :(

Maintenance Fund - Tier 1 General Extension

hi, I have suffcient maintenance fund, but in two savings accounts. I am applying for extension in Tier1 General category. Is this acceptable?

FLR (HSMP) under JR, with dependent

13/Feb - special delivery
16/Feb - arrived HO, payment debitted
17/Feb - ref no. by post
05/Mar - visa granted
06/Mar - documents received

14 working days in total.

Acknowledgement received on 12th Jan

- Caseworker advised me to send recent photographs on 25th Feb, which were sent on 26th.

Documents sent:
9 months payslips, last year P60
10 months bank statements
Papers related to a couple of investment properties

I don't know. The company in which I worked in got divided and I was put into different division. The company didn't have proper letter heads for the new company. But, the salary slips did have the new tax reference number and the salary credits were being made properly into my bank account.

After a painful wait for 7 weeks , I had my turn of good news today

Application type : extension - Non JR
Application date : 21-Jan-2009
Acknowledgement letter: 22-Jan-2009
Status as of 06-Mar-2009 : Caseworker not yet assigned.
Status as of 10-Mar-2009 : Got my passport ( +1 dependant) with Visa approved for 3 years

I was surprised that the entire process just took only 1 working day for me assuming that status given by home office is correct.

Okay, so finally I got the 3 yr extension. I applied on 10th Jan, and have received the papers today (10 Mar) :)

HSMP to Tier 1 Extension - Documents

I did a switch (in country) to HSMP from Work Permit April 2007 and now going for a tier 1 extenstion/switch. Can you tell me what documents you had to attach with your application ? In particular did you have to send any of your prior Work permits approval documents(prior to HSMP) ?
Assuming alls well with the new rules for a HSMP holder.. please can someone who did the same give me more info.

Iam planning to send the following
1)payslips
2)Bankstatement
3)Lettter of employments
4)Passport

Hi all,

I sent the following to immigration but they are not accepting email. Ive also had a hunt thro the posts and seen a couple of questions the same as mine but with no replies. If anybody could help with the below, i would be very grateful:

I am soon to apply for further leave to remain. I currently hold a HSMP visa issued for 2 years that is nearing an end and thus I am to apply for extension under the Tier 1 – General (having replaced the HSMP scheme). The details of which are below:

Initial approval letter granted: 12 December 2006
Entry Clearance given: from 01 June 2007 until 01 June 2009
Landed in the UK: 10 June 2007

My two question’s are these:

As the Entry Clearance started on the 1st of June 2007, and I entered the UK 10 days later on the 10th of June 2007, there is a 10 day difference. I intend to settle in the UK and under the current rules, to apply for Indefinite Leave to Remain I need a continuous period of 5 years in the UK. On the assumption I get approval soon for Further Leave to Remain of an additional 3 more years starting 1st June 2009, I am concerned that after that period of 3 years when I want to apply for Indefinite Leave to Remain I will be 10 days short of the 5 years required.

a) Will the department reviewing my Indefinite Leave to Remain application, take the start of the 5 years living in the UK from the 1st of June 2007 or the 10th of June 2007? Would 10 days be insignificant anyway, and consider my time in the UK to be 5 years regardless of the fact that I arrived 10 days later on the 10th of June 2007?

b) If the 10 day difference is significant, should I (and can I) ask for an extra 10 days added to the 3 years when applying for my Further Leave to Remain?

Hello Dave,

The 5 year-clock starts from the day you arrive in the UK and not from the date of the entry clearance visa. In your case, the clock started on 10/06/2007.

When it comes to applying for ILR, you can (under the current rules) apply for this within a month of the completion of 5 years in the UK (i.e. 4 years and 11 months). Therefore, you'll be able to apply for ILR on 10/05/2012 or thereabouts, which means that you will not have to worry about the 10 day gap.

Hello Dave,

Can anyone tell me what happens if your application is still being considered and your leave to remain expires while waiting,
1) Should you continue working?
2) When your visa is finally approved, what date does it start from, date of approval or date of last expiry?

Not sure about your point 2 but for point 1, called up HO and confirmed,

if the visa expires and your passport and the application is still with HO, you are legally allowed to work in UK.

Im also into same category.
