postal ILR [judicial review] time scale

The web site now says that is up to 6 months. The official line of the immigration enquiry bureau is 4-14 weeks.

there were several sent 20ish in May, received back with ILR last/this week ... so 2-4 weeks so far for JR

I did post my application for ILR on 25/05/2009, fee deducted on 27/05/2009. Documents not received yet.

I drop 28/05/2009. Still no progress and HO said when i called that its under progress.

That is impressive and I think postal is proving to be more effective now than the PEO appointment which takes 6 weeks and more expensive! Congratulations...

I received HSMP dated 27/07/2004 for 1 year
arived in uk 04/10/2004
first extention received on 27/07/2005 till 27/07/2008
second extension application date 21/07/2008, extension received till 03/09/2011
ILR Received today 24/06/2009 with letter back dating from 05/10/2008.
Have been refused one off check with condition that i had not met 4 year HSMP criteria for indifinite leave to remain.

Please help, I was expecting £750 which seem ....bad debt now

It is not clear in your story above why you were refused the one-off payment. What is the real reasn behind this decision? When were you told that you were not entitled to this payment since you received your ILR just today? Did you applied separately or what?

Also, was your ILR application done by post or at PEO? Thanks

Usually they have a list of possible reasons and tick the reason why you don't qualify for the refund. Judging from your timeline, I think it's because you would have needed a second extension anyway. Your last visa was only until 27/07/2008, you were not eligible to apply for ILR until 6/9/2008 (28 days before you completed four years).

There are similar cases like this at HSMP Forum. I don't think you can appeal it, UKBA are correct.

Congratulations on getting ILR! Don't think about the £750, ILR is the more important thing.

Dear Nazakat, Seems that you have been refused for refund due to fact that you donot complete 4 years on basis of first two visas and you had to get extension to complete the four year qualifying period. This is the only justification of refusal.

Got mine ILR stamped within four weeks (application sent 27/05/09 passport received back 25/06/2009)
They also considered my WP period prior to HSMP and letter mentioned that they will refund money soon.

it was mentioned in the same letter they back dated my ILR.

Is there any one who obtained HSMP outside UK, arrived in UK after 28 days and have obtained ILR and refund for second extention.

so conditions are

1- HSMP obtained not being in UK
2- Arrival in UK after 28 day of visa date
3- Have obtained 2 extentions and ILR
4- Have obtained Refund for 2nd extention

I met the first 3 conditions but did not qualify for refund.

I recieved my passports with ILR stamped. I am in the category of 1+3+3 on HSMP.
application sent 2/06/2009
acknowledgment recieved 6/06/2009
visa stamped 2/07/2009
passports received /07/07/2009

yes I also recieved a back dated ILR letter.the same letter says that there is another department which has been instructed to send us a cheque of one off payment. I also requested for compensation of child benefit and the difference in fees of ILR last year and this year. I have been asked to contact the customer service with the grounds of compensation. I will soon write a letter to the customer service about this compensation.

I also arrived in the UK after 28 days of my entry clerance visa had been stamped initially. Does this means that even if I had applied for ILR after 4 years, this would have been refused or possibly converted into limited leave?

Does anyone knows a link to these rules on UKBA website?

hi zeeshan, it depends how much longer after 28 days. some people who came after 35 or 40 days after EC/visa still get the refund, some don't. i don't think they count that carefully. but if it's 2 months or more after EC, that's very easy to spot and it seems most of those get rejected for refund.

as for the UKBA links -- you can go to the webpage where they have the JR implementation and refund; and the page that says you can apply for ILR 28 days before you complete your residency requirement.

Finally!

Finally the wait was over for me today as I received back my document and ILR in UK. This was a postal application:

Application type: ILR plus 1 dependent
Application sent: June 16th
Money debit from Account: June 17th
Acknowledgement letter date: June 17th
ILR Stamp: July 10th
Document received: June 17th

Doc sent:
1. Passport (2)
2. P60s (5 yrs) (myself + partner)
3. Payslips 2 months (April & May) (myself + partner)
4. Letter of employment (main applicant only)
5. 12 months bank statement (myself + Partner)
6. Mortgage statement
7. Marriage certificate

I can't explain why it took HO so long to send my document. I actually called them yesterday afternoon telling them I needed to know the stuatus of my application due to an urgent development in my country. The person I spoke with only told me (after so much pleading), that nothing in the post yet but if I don't receive anything by next week Wednesday, I should call them back. Then immediately, I know the application has been processed.

I received the backdated letter and promise of a refund (hopefully soon).
