HI THERE

PLEASE could anyone tell me what to do next, last week i received determination from the AIT that my appeal was allowed, i have waited for the HO to see if they will appeal the ruling but up till now i did not received anything.
please i need your expetise ideas of what to do next, should i just write to the AIU in leeds informing them of the decision or they must have known about it now.

After you have received the determination letter you will not hear anything untill the BHC have received notice.They will then send a call letter or e-mail depending from which country you are from to either go for a medical or submit your passport.
You can phone the AIT and ask if the determination has been sent,this usually takes 6 weeks to get to the BHC but again depending which country you are living.
Well done for getting this far,the hard work is over and the waiting begins!!!!

Just call the AIT customer service and find out if the counter-appeal has been lodged by BA.
If not, wait 2-3 weeks and if not heard anything, call the POU and find out where your file is. Normally if they decide not to appeal, they would send it to the AIU for processing, who will be in touch to request your passport and photos for the status evidencing.

Many Thanks Jeff, please who is POU ? and what does it mean? and can i have their number? and if you know the AIU telephone number as well please can i have it and their address as well, yesterday i did called the AIT to confirm if they have received any counter appeal they said they did not and by that the 5 days grace and permitted by law lapsed.
do you think they can still appeal? now because the grace has lapsed?
please let me have your thought? ALL

Read the above link, it tells you the Appeal procedure rules and regulations. This applies to both in country and out of country appeals.

The AIT will not help or advise or get involved further. Their job is done. Its now up to the Home Office to sort your matter out.

Reading your post, I think you are worrying to much over nothing. You have won your appeal , the HO have not appealed against the Adjudicators decision within the time limit. Just be a bit more patient and wait to hear from HO.

Thank you Batleykhan, yes i have read the likn,it did say much about the out country visa application, but did not say a lot about the in-country allowed appeal, please is anyone here in this forum who has gone thru this process before? (in country allowed appeal) please..i will surely need more help and assistances.

The address i gave you in leeds is for the presenting officers, they act as prosecutors in your case at the AIT but the other number in London is the main implementation unit(Border Agency-they decide wether to appeal and they are central to dealing with appeals and implementation)

No, you do not contact AIU until you are sure that your file has been sent to them - they won't help you. You need to contact your POU and if they have sent your file for implementation, then you contact AIU:

Appeal outcomes (allowed ones) are reviewed by a special division called ORAT (don't ask me what it stands for because I do not know) at Presenting Officers Unit in London. Those constitute the lawyers who specialise in the UK Immigration Law and who work for the BA. If they feel they have legal grounds for further appeal, they will state them and pass it on to Presenting Officers, who will lodge it with the AIT Senior Judge. The Senior Judge will review it and respond whether he/she feels that there has been a material error of law. If there has been, a reconsideration will be ordered and you will be advised in due course. There is a 5 days limit that applies.
If the AIT says that there has been no appeal by the BA within the 5 days limit, then your file should be passed on to the AIU for the status to be issued.

There are telephone numbers but all of them are confidential and mainly intended for the use by the BA staff.
The telephone numbers are the last resort only. You need to write and put your concerns in writing to them. You will then get a response or a phone call from the POU - they have been pretty good at that. If they cannot resolve the issue and you have a complaint, it will be passed on to the Appeals Directorate Director General office in London on your behalf, who will respond to you.

At the moment, you have no reason for any complaint. If your appeal has just been concluded, you have to wait a few weeks before making any contact. I would allow 4-5 weeks before taking any further action.

I really thank you so much, it seems to me that you have worked for this organisation before or still currently working for them, i would not go any further no more...i will be taking this on board and looking forward to hear from the relevant HO department to contact me.

No worries, mate. :D No, I have not worked for them, as I have never been a British citizen :) In fact, I will soon be Australian.
I had lived in the UK for nearly 10 years and fought my case there, which had eventually been successful but I left the UK nearly 2 years ago and headed to Australia where I got a job and I have been living here since.
The UK Immigration Law is very interesting thing (a lot more than that in Australia) and I got really interested in it when fighting for my immigration rights there. I had a complicated case with the BA when they lost my file, evidence of my status, etc. It took nearly 8 years to resolve. Like you, I went through an appeal (without representation), which had been successful. To ensure the best outcome, save money from paying useless solicitors, I went deep into research of the BA system, rulings, legal procedures, internal policies and their own structure. The help from this forum had always been great, too. Although I have not been up to date with the most recent changes in the law and within the BA I still remember a few things and happy to help when I am able to.
