see these comments from above page, as well:

"I have therefore made a commitment to commence earned citizenship no earlier than July 2011, and placed in the Bill clear assurances, first, that people who apply for British citizenship before the earned citizenship provisions are commenced will be treated under the current law; and, secondly, that the transitional arrangements on the commencement order must allow for citizenship applications that are made within two years of commencement by those who have indefinite leave to remain on the date of commencement, or by those who are granted ILR following an application pre-dating commencement, to be considered under the current law.

So if one gets ILR before July 2011 then you in old rule. Non who are getting approval this year will be eligible for old rule. Not sure if Australia, New Zealand and Canada(specifically) better option. Loooong frustrating 8 years!

The RA assent confirmation news is available officially on parliament link. There's another thread in this forum discussing pros and cons of this new approved bill which would get implemented from July 2011.

will it will for Tier1 immigrants as well ? i dont think so?
cause when HSMP started there was clearly defined that after 5 years they will get ILR. then how come they can make it for 8 years. if its true then again HSPM forum will file a case against them as they did before and will won ?

this new rule may possibly implemented from July 2011

this new rule may possibly implemented from July 2011
we all know by now that its going to be from July 2011. but does this mean that people who are at the moment on Tier 1/2 will be affected. The answer is prob. yes.
The 8 years time line for PR or for Citizenship?

its not fair........... it should apply to every one.. why only those people who are getting ILR after july 2011 ........

The fact is when Mr. P.W. become minister he made his intentions very clear.

No one cares wheather justice is been done to an immigrant or not.

I am not sure if that can be done as it is being passed as a bill in the parliament.

Can anybody please tell what is this Part2 means. I know I am definetely going to be affected.
As I read from the heading is it 8 years to get British Citizenship than 5 years plus 1 year on ILR.

What else are the new rules in.

Please explain me.

trust me its totally unfair...
my friend got hsmp in 2006 v easily by showing only experience.. and ME i got after a hard struggle to claim points to get initial visa..

then very easily he got extension by showing ONLY economic activity..... and me i again struggle hard to make my earning to claim points.

Now very easily he will get ILR after 4 years on HSMP and me on 8 years............. NO WAYYYYYYYYYYYYYYYYYYY

ITS TOTALLY UNJUSTICE..............

y not HSMPIAN case for any benefits for US

rules and policies should change but not for HSMPians as HSMP was introduce to get ILR in 5 years . thats all i want to say

There is a talk on cutting the link to citizenship. This rule will be discussed if there is lot of concern about UK population growing above 70 million. Infact this was brought up by one of the members in parliament. But good thing is that they do take care of people already on board but sometime not everbody can fit into it .. just like this 8 year rule.

That's not clearly mentioned in the bill but when part 2 comes into effect it's highly likely that the 10 year and 14 year routes will be done away with.

Someone had queried about what part 2 is. Part 2 of this bill deals with active citizenship and the route to settlement in UK. Part 1 of the bill is already in force. The bill was given royal assent on 22nd. The immigration minister has assured that part 2 will come into effect no earlier than July 2011.

Well there have been two successes of JR on restrospective changes:

1. Related to hsmp changes being applied retrospectively.

2. ILR rule of 5 years being applied retrospectively and the basis for win in this case was that the documents on hsmp said that ILF would be granted in 4 years. So on same line the documents for tier 1 currently say that you get ILR in 5 years. So why would govt risk another JR loss and apply it to those who are already on tier 1? If they do then why can't another JR be won based on the documentation like in previous case?

I am not a legal expert but through the knowledge gained by browsing this forum I learn that you cannot initiate legal proceedings against a primary legislation which is what this bill is.
