Gaps in employment while transiting WP to HSMP

Dear forum members,

I'm about to apply for ILR as I have completed my 5 years in three catagories leading the PR ( WP + HSMP + Tier1).

My concern is regarding my stay in WP.

I have acquired my WP on 2004 till 26 Aug 2009. But I worked for that company only till 2006. I have stopped my work with this company and the company has sent a Premature End of employment form to Home Office. But I have not received any letter from Home Office to leave to UK. Then I applied for HSMP which I has been approved in 2006.

I was on HSMP for two years since then and also being employed. In Oct 2008 I had HSMP extension which was given as Tier1. I'm on Tier1 since then.

Can I amalgamate all these catagories and apply for ILR? Even though my work was premeturely terminated I still had a work permit which was curtailed after I have been given the HSMP.

I appricate any advice please.

I think ur eligibility depends entirely on wat date ur employer informed the end of WP to HO? and when u applied for HSMP

I have applied for HSMP after the employer has sent the end of premature employement form.

So what should I convey to case worked about those 6 months where there is a gap.

What date did you start on the second job? Didn't the second employer question your WP status?

If you worked in the second company with your first WP then you were in breach of immigration rules. Even if you had applied for HSMP you were not allowed to work until it was approved and FLR stamped on your passports or atleast in the process of being stamped (I know HSMP was a 2 stage process back then).

HO might not be aware of this and you may be granted ILR but still you run the risk.
