My wife and I applied in February we recieved the COA, its been 6 months now and we would really like to travel, not urgent, but at the moment we can get great deals on flights to Europe which we would like to use, I have a German passport and she has a South African passport, would she require any other form of visa to enter European countries or is going to passport control with me enough, her 6 month FP expires in July, but in it, it states that she is a family member of myself, and we do have the COA and proof of the post office with the referance numbers corresponding with the Border Agency,
Any help would be greatly appreciated,

Hi, everyone!
I can see a lot of frustration here...but would you imagine, how frustrated and trapped are me and my husband? as we been waiting almost 1 year!!!! I;m lost...didn,t know what to do, where to go...which step to take...the first thing I ever done is requested info tru FOI, waiting and relying...to get a rejection in the end!!!
the system is ridicilous, and situation out of hand now...
Did anyone write complaint to UKBA? I need some help with that, do anyone had success after complaining?

got my passport EEA2 last june, it took more than 9months, but my husband still dont have his passport...

Me and my husband done mistake of not taking action straight after 6 month ran out... started to think and investigate what we can do only after 8th month... when started getting funny answers over the phone.... first THEY reassured us that there been backlog, and waiting time raised to 8 months, but thats maximum-we won't wait any longer... than when we called next few times, we got responces like- Oh..can't tell you right now...(or)... another month, or two...(or)...it take up to one year at the moment!!! :shock: then I've started wrighting e-mails (which never get answer on) so, now about to write complaint and letter to my MP.

as well as e-mail I've sent faxes to Liverpool...no answer as well :( and phonelines really annoing-so hard to get thru !
I never-ever writen complaint to anywhere...so thats confuses me as well..how do you write complaint?

Well you are not alone.

But do complain to your MP and get in contact with solvit. We have been able to get on the phone with the Home Office in Liverpool, but they couldnt give any update except they were saying we busy...bla bla.. and cant give and info.

YES! YES! YES! They are absolutelly useless!!! I so hope some of them ever read these treads and feel they worse!!! :evil:
I did sent e-complaint on Monday 27th, so fingers crossed something good will come out of it (I know it's naive, but-maybe). I've given them one week to reply back to me, so we'll take next step according to it...

OmarA - what is happening with your case now? Have you heard anything further or got any correspondence from the Home Office? Do you have a Case ID and a caseworker? Do you need their fax number? Please PM me. Have you had responses from SOLVIT or from your local MP?

I am having the most frustrating time of my life with the HO, mainly because they sent me a letter that I didn't receive and are refusing to budge from their stubborn and ridiculous position. It's no use calling the phone line, that will not make any difference to your case. And when they say they don't know, keep asking questions until they hang up on you. They almost always have more information than they will tell you the first time around.

Nothing so far at all, none!

No Case ID, no caseworker!

Sent them so far 5 or 6 signed letters, no reply at all.

Sent letter to local mp, and he did reply saying: The he will be asking the Home Office MP, bla,bla, and he will write to me, this is about 3 months ago.

Did get in touch with Solvit about a month ago, asked them for update 10days ago, and they told me nothing yet, as they will be in touch with me once they hear from the Home Office... and it takes time!

We did speak to them last week, and the only thing they told me:

This was the first ever we able to speak to them, but this is after choosing the options for returning the doucments!

We are still waiting since Sep 2008!

We cant travel outside the UK.

But I guess the MP's are now on 82days holliday, and they wont come back before 15th of October!

Home Office are more busy watching porn together with Jacquie Smith and her husband, wonder what was the title of the rubbish they were watching!!!


If we ask to return the passport, can my wife then fly back to the UK without issues on the airport with UKBA? And will it take longer if she send her passport again after we come back from holliday? or is it better to leave the passport with the Home Office and plan holliday later once we receive the RC?

Confused.DOT.com :(

Omar - this is terrible. What an appalling way to welcome people to the UK. What really gets me is that you and your wife have the RIGHT to be here! The Home Office is infringing on your right for freedom of movement within the EU by not resolving your case.

I will PM you with some more information about the avenues I tried - for me it worked, although I am having some unrelated problems now.

You absolutely MUST get some paperwork from the Home Office with at least your Case ID on it. Insist and insist that they give you a Case ID number. Once you have that, you are in the system. With that piece of paper, it will be much easier for your wife to leave the UK and come back in.

I made the fatal error of assuming that because we were in the system, I could freely leave the country, only to return and find that my application had been refused. I am now on a visitor visa and frantically trying to get the HO to overturn their decision. Do not make this same mistake. If I were you, I would not plan an overseas holiday until you have a recent document from the Home Office that you can show to the border officials. If you are travelling with your wife, it will be less of a problem, providing you have your marriage certificate with you.

I will have heart attack if our case will be rejected after so long wait!!! (knock x3 on wood)
I also don't have Case ID, but been told that my caseworker TEAM called LNC3 or LNC free? but anyway no help there...
feelling so tired from banging our heads on the wall called HO, deffinately writing to MP and Solvit- 2morrow, trouble with finding time as well, as we have daughter who about to start nursery!!! pets, house , work and other problems, parents and families living in diffrent parts of the world... I don't know for how long I will last like this...
OmarA do you mind me asking wich nationality you are? I'm asking as I have suspicion that cases involving asian nationals taking longer time...

I am Dutch and wife is Iraqi, check my other posts to know my whole story!

I got a case ID after asking them to get it on the phone, and will send them a fax requesting to receive a letter with a case ID, hope this way to know my case worker.

Have you emailed liverpool for an update on your status? Have UKBA sent you a letter of apology? If so, should have your case ID there.

well I did complain to the ukba nwcs unit per email, and the only thing they said to me: your complaint been forwarded to the case worker department for action!

This was well over a month now and nothing else...
No letter or anything else...

Hi,
I am a family memeber of EEA national(Poland), We got married two years ago and after marraige I applied for residence card (by my concultant) and i was granted residence card in 5 months.Unfortunately i lost my pasport two weeks ago.I phoned HO and i was told that i have to re-apply by filling EEA2.
Now i want to apply for Residence card myself but i am very confused and not sure how to properly apply and whether its applied by me or my wife.
What i would like to know that does all the sections compeleted and signed by me or my wife(EEA national) needs to apply on my behalf.
What i can understand is that
Section 1 is for EEA National
Section 2 is Non-EEA
Section 3 EEA National
SECTION 10 I am not sure
Please correct me if i am wrong.
My wife has got residence card about year ago.Does she still needs to provide her two photographs.

Faisal,

I agree it is very confusing as to how to fill out the EEA2 residence card application form. Make sure to read through all the notes on page 2 (Section 6: Completing the form).

My understanding is that it is the non-EEA national that applies using this form. Please, if the description below is incorrect, can somebody correct it.

Section 1 is for the applicant, which is the non-EEA national applying for the residence card. In your case, this is you.

Section 2 is for any OTHER non-EEA family members included in the application. This could, for example, include children. If you no-one else is included in the application, do not fill in this section.

Section 3 is for the EEA national (also known as sponsor) to complete. In your case, this is for your wife's details.

Section 10 is for you, as you are the person applying for the residence card.

Six Months was up today. Contacted them on the phone - was told that it may take a year, and our application has not been opened yet.

Have written the usual complaints to Solvit and NWCSU@homeoffice.gsi.gov.uk.

There must be some other course of action to force the UKBA to get its self sorted out, or failing that some method to seek damages from their breach of the regulations. I mean what is the point in having a rule like 6 months, if nothing happens when its breached?

I have a few questions to youdid you work till now?
My COA application they wrote ''before the work Employer must confirmation from home office''
because I came to England for a student after that I got married,Im never worked and I have not insurance number.
Couple weeks ago I fined jobs and they are sent formal letter to H.O about me for a confirmation,but they didnt send any letter and I do not know what can I do? anyone know about that something?

Dear,
In your case if you didnot have job and NI no as you were full time student but now you found job and your employer has varied of your placement and sent to HO.
Now wait and carried on working and while working just apply for NI number as your will need it.
HO always takes months to relpy.
I got my first replied after 4 months.
Second option
Being a full time student if your provide your full time education enrolment and evidence of funds then you could apply.
Pls anyone correct if i am wrong
