FLR APPLICATION-16MONTHS WAIT AND STILL UNDER CONSIDERATION

any help or suggestion will be appreciated.

Met Hubby in the uk year 2005 while he was on holiday on a 6mnths visa.
he went back to his home country.

came back to the uk on a 2yrs visiting visa in 2006,(was meant to use only 6months (180days)
Love Got over common sense, so we Moved in together
He Overstayed his Visa!
applied for a C.O.A (certificate of Approval in 2008) Certificate Granted.
Certificate Granted based on additional proofs we provided.
Got Married In 2008. submitted .FLR as a spouse of a british Citizen since april 2008
Application still under further consideration.
16months wait so far so bad.
Husband not working.
I am working, earning a little and stuggling to pay
house rent, council tax, and every necessary bills.
not claiming any benefits or whatsoever.
Husband Frustrated due to been stranded.
Just found out, we are going to be having a baby, which means I cant continue working for too long.

struggling financially, due to Husband not been able to work
and running into more debt each day, to fund our survival
any suggestions or help please.

Trust me. I wouldnt wish this experience on my worst enemy, But its life, what can one do, just have to get on with it

Your case look like those Chikwamba kind cases.

They do take disproportionately long to deal with them.

You will have to exercise some patience.

I think you would have been better of applying for a spousal visa from his home country.

Also you can contact your MP, who might exert some pressure on them to speed things up.

Have you any child with him?

does anyone know if you can apply for in country LTR off the back of a 2year visit visa?

I’ve a feeling the quickest and best thing to do is to find out
1 - if your hubby will be banned from coming back if he tries to apply from his home country
2 – if not, withdraw your application before they’ve a chance to reject it, get him to go home and apply from there. Honestly, it’s sounds painful (& expensive), but it could be the quicker route.

other options:

(a) Going to a Judicial Review is specific to a certain group of rejections – ones where the application has not tried to “jump the queueâ€
