p.s if i wanted to request my passport back as i am the british national, would that delay the progress of the appli1cation?

Hi,
If its your wedding or close relatives, thats a very good reason to request for urgent treatment. you can send a fax with wedding invitation and they have to consider as its once in life time.

Cheers,
All the best.

10 years long residence

Post by taylondon » Sun Dec 06, 2009 1:18 am

I have just found the following decision from Immigration and Appeal Tribunal web site:
Appeal Number: IA/23952/2009

This Iranian Gentleman and his wife with 2 kids submitted an SET(O) application on the base of their 10 years long residence.

They Submitted on: 27 January 2009
Gentleman got refused: 11 August 2009 (because he was 560 days out of UK within 10 years)
wife and 2 kids got ILR: 11 August 2009

gentleman went to appeal. His appeal under immigration rule is dismissed, but his appeal under human right is allowed. Judge decided that the gentleman has got a private family life and HO cannot break the family life

ILR HSMP (JR) RECEIVED IN 13 WEEKS

Post by London102 » Fri Dec 11, 2009 9:35 am

I am one of them who received their EC in the early days of HSMP ( EC:January 2003, Landed:February 2003). I could not apply for ILR in time due to excessive business travel (I am employed by a multinational) and few other reasons that delayed this stamp in my passport for almost 2 and a half years (lost first passport that had the EC and hence was not eligible for the premium processing. Though applied twice through premium service but both times the case was taken to back stage. For both incidences, the case could not be finalised within 2 months and hence had to withdraw due to urgent business travel. Finally made postal application in September and results are as under)

Applied for ILR SET(O) - HSMP JR + 2 Dependent
Document sent 08th September
Document recieved by HO 11th September (Due to postal strike)
Ack letter recieved dated 12th September
Payment gone through 11 September

Extra documents request 31st October (Letter received on 6th November asking for last 3 months bank statements, payslips and first passport that has the HSMP EC. Though all of this had already been submitted with the application. Sent fresh copies again)
Extra Documents Sent 10th November

Another request for some explaination on EC received 25th Nov
Explanation letter sent on 1st December (HO received on 2nd December)

ILR Issued on 07th December
ILR Received on 11th December

So exactly 13 weeks altogether.

Good luck to all awaiting decision.

Regards,

I applied for the application on the basis of a Work permit converted to HSMP (MBA scheme) and then final year on Tier 1. Fairly straight forward application along with dependent spouse with not more than 100 absences.

Filed: 8th September 2009
Acknowledgment letter: 9th September 2009
Paid for: 10th September 2009

Had emergency travel so requested expedience in processing on the 03rd December 2009 or withdrawal of case in case they could not respond. Several subsequent faxes to get an update from them but no use. Called today as 14 weeks gone but they said I need to one more day as the rule is you can after 14 weeks have passed not when 14 weeks have passed. I don't even know whether my request was forwarded to the relevant team.

Anybody have the same timelines? Have you been issued an ILR? I can see some lucky brothers and sisters who have but some more responses might be encouraging. Does anyone know how long before the relevant case worker team receives correspondences and sends passport back.

Any quick reply would be appreciated.

Goodey--
Applied 16th Sep
My ILR was stamped on 7th Dec.
Received 14th Dec

Guys,
If its straight fwd application WP+ Tier-1 then it looks like 12-13 weeks. My case was little complex but end of 13 weeks I got it. If 14th weeks just wait you will get it very soon.

Cheers.
