family member transfer from 6month tourist visa

Post by sidzz » Mon Jan 04, 2010 10:25 pm

If an adult foreign national came to visit family members on a 6month tourist visa, what if any options are there for her to remain in the uk beyond 6months. I understand that the tourist visa cannot be extended further, but is it possible to transfer to a different type of visa? study? work visa?
Any advice most appreciated, Thanks

Nope, they have to leave in order to apply for any other visa.

There is a provision for a MEDICAL visit visa to be considered for extension if the visa holder, the patient, is required to stay beyond 6 months for the treatment.

For any other visit visa types, you can't extend or switch to a different visa category from wthin the UK.

Not true, literally it ia not a visa, but u can transder into the EEA dependency family member and obtain the EEA resid card. That's what my wife's parents did, came on a tourist visa and stayed on with eea rc. Otherwise, unless u r a victim of some persecution and wish to claim an asylum, u cant really.

None of the advice/opinion is expressed with the view of assuming responsibility as to its accuracy. Anyone intending to rely on any advice/opinion should seek independent legal advice before acting upon it.

You can't apply for an EEA permit unless you are a dependant of an EU/EEA national.

Thanks for all the advice,
If the person in question's parent became a british citizen a few years ago would applying for EEA permit be a viable option still

NO!
Unless 'the person in question's parent has lived in another EU country (after becoming British) and exercised their treaty rights there, before returning to live in the UK again (Surinder Singh rule).
Also that the person is under 21, otherwise has to prove dependency!
