ILR and ESOL

My partner has to apply for ILR and needs to study ESOL at the local college in order to apply.

The college tell her that because her Entry Visa says Unmarried Partner instead of Spouse she has to pay £800.00 for the two four month courses. If we were married (for one year)the courses would be free!

Can anyone confirm this for me as it seems to be unreasonable discrimination?
