Indian Company Offer for Tier 1 Candidate in UK

Post by lovetier1 » Thu Feb 18, 2010 1:35 pm

Dear members,

I'm on Tier 1 visa holder (valid till Nov 2011). I'm doing contract jobs in IT sector in UK. I have got an permanent job offer from an Indian IT company. The offer says that , my base location will be in India (their company headquarters) but my work location will be in UK. I will be in both UK and Indian payrolls. Means, I will be paid UK salary in GBP here and Indian salary in my account in India. I'm eyeing towards permanent residence in UK, please can anyone suggest whether there will be any barrier in my way to permanent residence, if I accept this offer ? Your feedback is much appreciated.

Thanks

Isn't there a minimum stay-away clause (like for 180days or something) in order to qualify for extentions?

I think it is ok as long as you have a VALID Visa to work and stay in UK and strictly follow the ILR qualifying rules as of now..
like:

1. You should not go out of UK for more than 90days at a stretch (though it has been discussed you can do that if you are on Business/company related visits or paid leave visitsetc..)
2. You should not go out of the country for more than 180days in a span of 5years
etc..
Please visit Indefinite Leave to RemainSection for more details/ queries

My work location is in UK and will not be India , but technically I will be an employee on deputation. As far as I know , as long anybody on Tier1 who has UK payroll and sufficient amount of funds in UK banik account(s) and haven't stayed outside UK for continously for 3 months shouldn't have issues for Tier 1 renewal and permanent residence. Please correct me if I'm wrong. Please provide your valuable feedback in my current scenario.

Location: does it matter?

There is no restriction regarding absences as far as Tier 1 (General) extension is concerned.

For ILR, the absences are limited to 180 days in 5 years and 90 days on a single trip. Absences over and above these limits may be ignored by the caseworker (at his discretion) if documentary evidence is provided from the employer certifying all work related absences from the UK.

Hope this clarifies.
