Gap of 28 days between VISA Application

I have completed my 5 years in UK, following are some of the dates for my work permit

1) Entry Clearance
Work Permit Issue Date - 21/10/2004
Work Permit Valid Until - 21/04/2005
Comments - Came to UK on 31/10/2004

2) Visa Extension
Application received by HO - 01/04/2005
Work Permit Issue Date - 20/04/2005
Work Permit Valid Until - 21/04/2006

3) Visa Extension
Application received by HO - 16/03/2006
Work Permit Issue Date - 28/03/2006
Work Permit Valid Until - 21/04/2007

4) Visa Extension
Application received by HO - 28/03/2007
Work Permit Issue Date - 11/04/2007
Work Permit Valid Until - 21/04/2008

5) Visa Extension
Application received by HO - 19/05/2008
Work Permit Issue Date - 01/07/2008
Work Permit Valid Until - 21/04/2009
Comments - Gap of 28 days to apply the Visa. Gap in my application is due to my wife’s Passport expiry, then delay in processing my work permit application by my organisation.

6) Visa Extension
Application received by HO - 21/04/2009
Work Permit Issue Date - 30/06/2009
Work Permit Valid Until - 26/06/2010

Will I get my ILR?

Did you overstay?

Yes, my Visa expired on 21/04/2008 and I applied for extension on 19/05/2008. I got my VISA extended without any issues in that period.

As mentioned by you, there is a gap of 28 days to apply but even HO has spent roughly 40+ days to issue the WP after receiving your application. It is important if you were in UK during this period & were there any issues raised by HO due to delay in application? Ultimately that stay of 28 days is illegal unless you justify it ( which you must have done which is why you got the WP). So if they were happy that time can also be this time.

Vchandani, the gap would be flagged up when you apply for the ILR. It is unlikely to be unnoticed. My wife has been in the UK since 1998 and there was a gap of less than a month due to the university not sending her passport on time for renewal. When we went to Croydon it was flagged up and her application was not received. I had to apply for Dependant Visa for her. You might be fortunate though. Work Permit application is not same as ILR as the continous residence requirement does not form part of the WP application. That's why it was not such an issue. Good Luck.

Could you pls post your ILR status, mine is also similar to yours but i went to india and got a new Workpermit and Entry clearance, gap of 36 days (including weekends). Not sure whether this new Workpermit has reset my first UK entrance. All my workpermits are overlapping.

Would be greatful if you share your experience.
