this home office people are driving me crazy. the last time they told me my case is being dealt with in croydon eventhough i went in person to liverpool and the require further enquiries, last week, i was told it has been seen by a caseworker then now they told me my case is with the northwest region again.

does anybody know why this is going back and forth for over 5 months ?

Apagun, under what category did you apply?

Perhaps the reason for your application to be sent back to Liverpool (Borth West) could be that it was sent to London only for some specific enquiries and that final decision is still to be made in Liverpool which is where you originally applied in person.

This is only a thought though ! but if this is true, you may not have to wait for too long now.

One more thing - I dont have a lot of confidence on what these people say on the phone. I have a friend who called to enquire about his status and he was told that his case has not yet been decided, but his passport arrived by post the same day!

Even my application is with the home office and I am hoping that they send my passport back in the next few weeks !

Good luck to you and keep us posted.

@tintin,

my application is on set(m).
before,i was told my application is in croydon,
i spoke to a guy last 2 weeks on 0870 number who told me that my application is at the caseworking unit. however, i wrote to the home office in feb complaining about the time i ve been waiting and i got a reply stating that my application has been seen by a caseworker and that enquiries have been made as well but they cannot tell me when a decision will be made that was dated the 26th feb. I called the sheffield pple today cos i dont trust the 0870 pple and the guy told me that my application is being dealt with at the northwest region .

Contacted HO again today but they have this robotic answer of telling everyone the the application is still not completed. I am bit frustrated at the moment as it nearly 4 months now with my 5 Year Set(o) application for ILR. I don`t know shall I contact my MP to help me or not. Please suggest!

Chadha, was your application complex in any way - in terms of absences, motoring offences such as speeding etc, benefits !

If not then I'd say that you give it another week and then get your MP involved. Lets hope you get your approval in the next week or so, I know its so frustrating.

Even my application is in the 7th week now, lets see. Two recent successful outcomes as posted recently on this form took 11 weeks and 8 weeks respectively.

I dont know why there is so much variation in the way they handle similar cases ... some people get it in 5 weeks and sometimes you hear nothing for 17 weeks as in your case.

I'd be quite interested to see any document that outlines the procedures that UKBA follows.

@Apagun - i understand your frustration. I would suggest that you give it another few weeks and then try and get your MP involved. There is not much point in ringing UKBA because they just read out the standard answers and put you in even more confusion.

Hi Tintin, You are right I had about 294 days of absences abroad but none of them were more than 90 days. Also, I was with the same employer since last 5 years.

Chadha, were any of your absences work related? If yes then did you include letter/s from your employer confirming the same. If no, then did you try to explain the ecess absences?

Barua, who got his ILR last week, also had absences in excess of the recommended upper limt but because he included a letter from the employer, he got it quite quickly.

Similar was the case with another friend of mine - he had close to 300 days but he sailed through!

Chadha, I can understand. From my searches on the internet it looks like your file could have probably been forwarded by the Initial Consideration Unit to the Case Management Unit which is done when further thought/investigation is required. I think you must seek some advice from an expert about the course of action. I'd suggest that you do this before involving your MP because any sort of pressure could make the HO to decide in a haste which may not necessarily be in your interest.

I think the caseworker has quite extensive discretionary powers and he could overlook the excess absences (the normal recommended is 180 days as you would already be knowing).

All the Best! Keep us informed.

I just spent some time going through last 5-6 pages of this thread and made a note of timescales for ILR based on WP and HSMP. All the applications were made during the end of 2009 or in 2010 itself.

The time scales are -

Romanion HSMP - 7 months
Fatcat HSMP - 7 weeks
Khankhattacks friend - 9 weeks
Booboo , 5 years WP - Applied 20.01.10 - Still Waiting
Tintin, 5 years WP - Applied 21.01.10 - Still Waiting
Badbug27, 5 years WP - 12 weeks
Chadha, 5 years WP - Applied 23.10.09 - Still Waiting
Goody09, 5 years WP - 11 weeks
Barua, 5 years WP - 8 weeks

Average, excluding romanion HSMP - Approx. 9 weeks 1 day
Standard Deviation - 2.4 weeks

Applied ILR SET(O) WP + 2 dependents
Application received September 09 2009
Acknowledgement received September 15 2009
Payment deducted September 22 2009

Request for additional documents received from Croydon on 15th February 2010
Documents sent on 26th February 2010

ILR approved on 16th March 2010
Passports with ILR stamp received by post on 17th March 2010

It was a bit complicated application with 2 gaps between 3 WPs and employment change. Applied after 6 years of stay, took a gamble of £1000 and so happy it worked.
Best of luck to everyone still waiting, hope you will hear the good news soon.

No news so far!

I have seen people in set m getting ilr those applied on 28th feb this year

I dont know why some people have to wait longer even for straight forward cases. It seems there is no consistency. it depends upon who is dealing your case

Hi Guys,

I received a letter from the home office yesterday. The packet also contained all my supporting documents except the passports. The letter says that my application has been approved and the passports will be sent soon.

I am finding this a bit strange, never heard of anyone else who received the supporting docs first and the passport later. Anyone knows if this has happened before and what could the reason be?
