Hi,

I am British citizen. My husband is not.

When he was in UK (he had student visa), he received a caution from the police for shoplifting. That happen by mistake.
Will this fact influence on visa decision to let him live with me in UK?

He shoplifted by mistake? :roll:

Anyway, I am not certain that a police caution will result in his spouse visa being refused. It is a spouse visa application right?

Yes, spouse visa.
Police gave him a simple caution and said him that is not crime, but they have him in their database.
Do you think it will be checked and visa will be refused?

He'll have to declare it if the app form requests it I think, always best not to hide anything.

I wouldn't think it would mean a refusal but it could if he hid it and they found out.

In application form questions:

1.Do you have any criminal convictions in any country (including traffic offence)?

But his situation is not criminal.

2. Have you ever engaged in any other activities that might indicate that you may not be considered a person of good character?

What would you recommend to answer me?

This is a caution not conviction and she dont need to declare that.

If it is in the police database then although not convicted it may be wise to disclose the caution.
You cannot then be accused of trying to obtain visa by deception

Dear cautions dont need to be declared..Only convictions..


So he would be fine..

But better check with some good solicitor.
