that is a good question to ask again from them, but the main points are.....
Average Consideration Time in Working Days (For Over 6mths) 563
Maximum Consideration Time in Working Days 2,060

which mean that for those wait over 6 months likely to wait 563 days to 2,060 days.

That's not strictly true. The average is 563 days not the minimum. 2,060 is just the maximum figure.

Also, consider that they count in working days (presumably to make the figures look smaller!), so 563 working days are in fact 788 days of actual waiting time (bank holidays excluded). That's an average of over 2 years!!!

The data you asked for also goes back to February 2009. We know that prior to August 2009, their record was relatively good with respect to 10 year ILRs, so I suspect a lot of the applications that fell within the 6 months are from the period February 2009-July 2009 and are skewing these figures with respect to the situation we now find ourselves in. Even so, as aman5 pointed out, their success rate of managing applications within 6 months falls well below 95%.

I suspect if another FOI was made this time looking at applications received between August 2009 and February 2010 for 10 year ILRs only, the figures we get would paint a very very sombre picture indeed.

I can confirm that applications made under 10 Years Long Residence are not routinely considered within Asylum casework units.

So what are the non-routine circumstances then under which 10 year Long Residence applications may be sometimes considered along with Asylum caseworker units?

Further query(s) in connection with 10 year continuous legal stay ILR.

1. (A) How many caseworkers (actual numbers) are exclusively dealing with '10 year continuous legal stay' ILR applications at the UKBA?

(B) Any steps being initiated by the UKBA to increase the number of caseworkers dealing with '10 year continuous legal stay' ILR applications as from 1st Jan. 2010 all '10 year continuous legal stay' ILR applications are to be sent to the UKBA by post?

2. Is there any internal targets set by the UKBA as to how many minimum number of applications of '10 year continuous legal stay' ILR should be dealt by caseworkers, on an average, at the UKBA every day?

3. What is the criterion when deciding the sort of cases of '10 years continuous legal stay' ILR that normally fall in a category that are to dealt within six months and cases which normally take more than 6 months to arrive at a decision?

4. What is the basis of allocating '10 year continuous legal stay' ILR applications to various centres (e.g. Croydon, Liverpool, Sheffield etc) in UK?

5. Once an applicant has sent his '10 year continuous legal stay' ILR application to the UKBA and wants to sent some further documents to support his/her application, how does he/she find out which center is dealing with his/her application? Calling Home Office on the phone to enquire rarely achieves any results as people taking the calls at the call centers sometimes are not very helpfull in providing the necessary information to applicants.

6. Out of an average of 100 '10 year continuous legal stay' ILR applications received by the UKBA, how many of applications falling under this '10 year continuous legal stay' ILR category (in percentage terms) get a positive outcome?

7. (A) What is the interval of review as to whether the target of 95% applications '10 year continuous legal stay' ILRs decided within 6 months is being actually met by the caseworkers dealing with such applications?

(B) What steps have been taken in the last one year to speed up the process to clear the backlog as from 1st Jan. 2010 all '10 year continuous legal stay' ILR applications would only be accepted by post. This may significantly increase the number of applications received in this category this year (as opposed to last year when some of these applications were being decided also by the same day premium service).

Hi boonbin

That was interesting Saturday morning reading.

My question is based on the average processing time for over 6 months as I think the figure is too great for a 10 year legal application. Taking the sample applications on this site, the average appears to be approx 30 weeks which is, roughly (very), 150 working days (I've not calculated bank hols).

They have confirmed that asylum cases aren't considered with this category but are 14 year long term residency (legal/illegal) cases considered along side 10 years applications? Are these statistics solely 10 or a combination of both criteria? If 14 year apps are included in these stats then this is not a true representation of 10 year legal applications and may over-inflated the stats provided.

My only other question would echo aman's point 3 - what criteria takes an application over the 6 month SLA? What makes an application "difficult"?

Got the passport back in the post this morning, ILR issued from 02 March 2010.

I only received my passports back, but my KOL certificate was not returned? Anybody know if this is normal?

Very relieved this is all over, I hope the rest of the August 2009 and later crew get their paperwork soon. It appears there is some more delay in posting as well as mine came around 3.5 weeks after my decision.

received letter from Phil Woolas (Minister of Border and immigration) today confirmed that my application under active consideration. they are look to complete their consideration as soon as they can.

hopefully can hear something back next week and real progress and decision will be made. wishes all good luck

did you called HO between 02 march - 28 march to find out the progress of your application? what replied do you get? i just wondering if your ILR granted on 02 march and they still tell you that your application not yet been decided?

did you applied via solicator?

did you received any letter saying your case under queue for awaiting consideration or under active consideration?

did you received any letter before you granted ILR?

what is the KOL cert?

No, I didn't call them between those dates. However, the letter received by my MP which stated my application was under active consideration was dated 10 March 2010, so I am not too sure what the process is to be honest.

No, didn't receive the first letter as I know some people did here.

The Knowledge Of Life in the UK test certificate which we have to send anyway.

Call HO to enquire as you may need KOL certificate again when you apply for citizenship.

The UKBA site says

If you satisfied the settlement-stage requirements to have sufficient knowledge of language and life in the United Kingdom you do not have to do it again. Simply tick the appropriate box in section 1.20 of the application form.

Kiwigal, thanks for digging up the rulebook. Much appreciated. TBH, I'd rather just do the tick box. I simply do not see myself trying to call the UKBA hotline again, if they return it, then great. Otherwise, the ticking will suffice!

I forgot to mention my application was done in Liverpool, so perhaps those who applied before me but haven't received theirs yet may be at Sheffield, so, hopefully soon guys. Will watch out this thread for sure!

Issued in Liverpool. I got my supporting docs returned before the passport - see my previous post. I also got my Life in UK test cert returned as well. Hope this helps.
