How to apply for spouse visa if married to a British

Hi,
I am on a student visa (Sponsored by the UK university for my educational fees) in UK and am married to a British from past 7 years. However we both were married outside UK and staying outside for these 7 years. I want to know whether I can apply for spouse visa or not (converting my student visa to spouse visa). And what documents I need to have to apply for spouse visa. We both are already staying in UK at present. However my spouse is on state benefit.

where did you live in the past?

Since you've been outside of the uk married for 7 years, you can apply for ILE after you complete the life in the uk test. However, ILE can only be obtained outside of the uk.

I am born and brought up outside UK. Just arrived UK a year back. And were married outside UK as well.
Since you've been outside of the uk married for 7 years, you can apply for ILE after you complete the life in the uk test. However, ILE can only be obtained outside of the uk.

If you are already in the UK
If you entered the UK in a different immigration category (for example, as a student), you may be allowed to switch into the category of husband, wife or civil partner if we have given you a total of more than six months' permission to live here since your most recent admission to the UK. This permission must have been given in accordance with the Immigration Rules, not 'exceptionally' (outside the Immigration Rules). For example, if we gave you permission to enter for three months and then permission to remain for five months, you have been given a total of eight months - which means you can apply to switch into the category of husband, wife or civil partner.

Your husband being on state benefits may, unforunately, be problematic depending on what benefits he is receiving.

Hi,
Thanks for your reply. I am currently on student visa with a scholarship from the University. Can I use this scholarship money (let's say after 2-3 months saving) to show the Visa funding (Visa requires a thousand of GBP in the account for continuous 3 months). And will it be a problem/objection if I am switching from student visa to spouse visa when I am getting scholarship from UK univ. itself.

Hi,
I am married to a British citizen and British national. I have stayed about 6 years outside UK (in India) before coming here to join as a student. I have already taken my Life in UK test. Can you please tell whether I should be eligible for ILR or not (considering I am already in UK on student visa with scholarship from University) and whether I need to go to my home country, India to apply for it. My husband is on housing benefit and other social benefit is stoped on account of our joint income.

In january it was 7 years now its 6 years? Is your husband now working?

We had married since 2003 and came in UK in August, 2009. My husband is still not working and we are staying on the scholarship (provided by the univ), and at the same time he is claiming housing benefit.

Was you living together as husband and wife for at least 4 years continous abroad? Why ddnt you apply for Spuose visa? Did you mention that you was married to a Brit when you applied for the student visa?

Yes, we were staying as wife and husband and still we are staying as wife and husband. My husband (although he was a British citizen/Passport holder) had come to UK alongwith me (staying with me for 7 years outside UK) after 20 years gap and hence we were not very clear about his status in UK. Second, rules were not very clear to us from outside UK after loosing a touch of nearly 20 years. Third, I had to decide about my joining the university as early as possible that left no choice but to apply as a student visa. While applying on the student visa, I had mentioned my husband's name as the accompanied family member. We have submitted our marriage registration while applying for the state benefit. And based on this (our joint income), his JSA has been stopped but HB is continuing.

That one is complicated for me but im sure some board members here will help you as they always do, If not then get some advise from an immigration specialising solicitor or an OISC registered adviser.

Thank you all. I have been granted FLRM today. It was all over with just passport and my last month bank statement (it took nearly 3 min).
