Residency application while appeal is pending

I am a British citizen and applied for a visit visa for my parents in January this year. Visa was rejected and appeal is pending. There is a court hearing on 1st week of august. I think the whole appeal process may take rest of the year.

Now, I am planning to apply for residency for my parents. Is it possible to make a reisdency application now, while their appeal for visit visa rejection is still being considered.

No,you can do one at a time.Either you allow the appeal process to go on or withdraw the appeal and make fresh application.

On what grounds? Do they fulfill the criteria?

Students cannot call parents as dependents.

I believe I will fulfill the criteria, as I am national and in full time employment.

But you said you where a student?

I and my dependants were issued a student visa for Jan 2010 entry.

And, are your parents both over 65, dependent on you with no local siblings?

This visa is the trickiest of all, and will cost you £3200 plus an undertaking of maintenance for supporting them.

Yes! looking at that thread, he is a student. How come a student become BC overnight. He hasn't even departs his home country until September 2010, according to his earlier posts.

OP is not telling the truth if you compare his two postings.If he needs help I think he should tell the real story

Well, not many people tell their true stories here. They will just keep asking different question from various angles, until they can get the information they are looking for.
