Query -Tier 1 - Income in India and UK

I am applying for Tier1.
The 12 month period I am showing is from 1st April 2009 - 21st March 2010.
I was self employed in India and moved to UK in mid September 2009.
I have been working in UK since December 2009 and have payslips since then.

Some of my payments for my work in India (before september 09) were delayed and were mailed as checks at my home in India after I had reached UK.
My parents deposited the checks as they arrived.
Total of 3 checks deposited in November/January '10 and March '10.

I have already filed tax returns on my total income in India, including these checks.

For my Tier1 I am including these 3 payments also as my income in India and applying uplift.

Can anyone please confirm if I can apply uplift to these payments too.

Yours is quite a tricky situation. I suggest you take some professional help. don't risk your visa.

I met a lawyer in London2 weeks ago but even he was confused
and was not sure what to do except to get letters from the clients explaining why the payment was delayed.

I was not fully convinced as he had never handled a similar case.

Can you recomend any professional services

Hi ,

I will try to give you answers for your message but be sure to contact as much people as can for final solution .

Let me break down what you have so far

Claimed Period: 1 April 2009 to 21 March 2010

Period you were in India: April 1 st 2009 to 15 Step 2009

Status: You were self employed

********* This part in your TIER1 application will cause huge set back as the payments are being made via cheques and deposited by your parents. You will apply the uplift indian factor for the amount you had received but my friend this will cause delays in your application as you are in UK now and ECO will refer your case to High commission in India to verify it . Please note that self employed earnings are always verified . In a nut shell this is your " down part" in application so please make sure you have best solution for it.

UK : This is straight with uplift factor of 1 and supporting documents.

I really need to get this through as many experienced people as I can cause though it seems like a common case but its tricky...

The checks were issued in my name and were deposited in my bank account.

I have statements to prove it.

My taxes were done by an accountant who is not a CA, but confirmed that he can get a certificate from the local CA he works with as a proof of earnings.

The company I always worked with has agreed to give me a proof of all payments made on their letter head along with the date work was completed and the check issued as for the payment.

I hope if any senior member can suggest what else can be done or needed for makeing my case stronger.

problem is

- You deposited your cheque after 3-5 months? ... which is confusing.
- AND cheque was deposited when you were in UK ... so applying uplift ration will add to another confusion.

If you can live without showing these 3 months then it would make your case easy.

the checks were deposited as they came... and in India payments always came 7-8 weeks after the work was completed ??

I need to show these as earnings else I wont meet the points needed.

Is there any way I can make it simpler or clearer for the officer who will look at the case

Your case may be a tricky one for the Case worker! I would ask the following questions:
Have I explained the anomoly in such a way that the case worker can spot?
Are the documents that I produce sufficient for a self-employed?

But a genuine case, with genuine document, with proper explanation would always succeed.

I hope if I meet the officer in person it will be easier for me to explain and show all needed documents.

What do you recon, is it a good idea?

Hi ,

It's a good idea but your case is tricky as mentioned above by my friends here . You use this type of service when you have really good , strong and straight case . What i mean is a UK case with 12 month salary , tax documents & bank statement .. Employer letter and supporting documents .

If you are happy to spend some fat pounds here , you can go for it but in most cases , they will give you time for further evaluation from their end
