Chances of getting family permit with previous EU overstay

Post by chuni8 » Wed Jul 07, 2010 6:34 am

Hello all!

My civil partner and I are living overseas right now (outside EU and UK). I am an EU citizen and got a scholarship to study at the UK, I'm getting there next month. My partner is not EU citizen and will apply for EEA family permit.

The problem is that my partner has overstayed in Spain for 9 months. This happened 7 years ago. Considering this past event, what are the chances of getting a refusal? We are really worried.

Many thanks!!!

As you are going to be exercising Treaty Rights in the UK, I do not foresee a problem your partner getting an EEA Family Permit, and later a Residence Card.

I overstayed in Spain for 2 years. The UK don't care.
