Would it be OK if I submit 6 weekly pay slips from the umbrella company (employer. First one is just based on 2 days week as I started in that week. It's a 3 month contract which started in july. There is a possibility for extension.

How should I calculate the net income every month (required in the vaf4a) after taxes or the annual gross salary as my contract is based on a daily rate. I understand the employer will need to put my monthly or weekly or annual salary on the reference letter as well. For the monthly salary after taxes, I am going to use net weekly salary * 4.

Also, we receive payslips via e-mail, they are not like normal pay slips we receive in the post. Would that be a problem or I should ask my umbrella company to provide a second letter outlining the salary payments for the 6 weeks?

Has anybody applied for a spouse visa while working through an umbrella company?

Alhamdulellah for those who are getting a good news may Allah make it khyr and full of happiness and goodness for them and for those like me who are refused then inshAllah it is khyr for them.

From Shakiya's account it seems that after submitting the appeal it takes 4 months to get to the hearing stage and takes another 3 months to get yoru passport stamped.
2 questions:
  • 1. When you go to the hearing, is it there and then when the judge tells you that the visa should be granted or still refused? or you still have to go through further wait to findout the outcome?

    They tell you there and then....

    2. Do the sponsor in the UK receive a letter after the court hearing to tell you that the appliant should submit their passport in Gerry's or the applicant is somehow informed?
    The sponsor or his/her representative (solicitor) will get a confirmation in writing within 14 days of appeal. Then it takes a month or so for the applicant to receive a call letter for them to submit their passport along with all the new tests etc.
May Allah give me and all of us sabar...

hi,
applied from VAC Lahore 12-5-2010. for Tier 1 dependant visa
Still waiting for response. UKBA site has published june 2010 data recently and it suggests that 85% tier 1 visas from Lahore were processed within 15 days. However, i know people who have been waiting since april . Can seniors on this board give me an idea about the actual visa processing time from Pakistan.

JazakAllahu khyran sis - I am in a bit of a trouble. My wife lives in Afghanistan and since there is no visa section in the BHC in Afg, Afghan national are adviced to submit in Pakistan. My wife submitted her application in Islamabad Pakistan we have a very distant relative living in Peshawar, we put his address in the VAF4 form as the contact address, if he relocates then we are in trouble because you said

i was told that it can take 2 months to 2 and half months for a call letter to arrive in post at postal address for applicant to submit the passport along with new passport size photograph, new tb test report / certificat, some additional postage fees by fedex, if more supporting documents were listed on call letter then send those documents as well all along with the appointment date to be given when call letter recieved.
And then it can also take further delays in stamping the passport, in some cases it had been 1 month and in some cases 3 months.


The appeal cases are such a time waste disaster
more likely 12 months in the line.

more likely 12 months in the line.
Is it not easier to just re-apply? Obviously will have to pay the fee again, but might be ofset by the shorter waiting time and solicitor fees?

I would recommend you ask BatleyKhan for some advice. Personally i think you should write a sepertate letter when you submit the appeal and indicate the issue you have with the post ........there may be an alternative.

c4_2007 .......... if visa is refused, ive been told that we can re-apply (even with an ongoing appeal)..........but then we run the risk of the ECO raising questions on other aspects of your application, thing is they decide as they please, what was ok for one ECO may not be ok for another ECO........i personally wudnt apply again, i would go through appeal process, long i know but eventually your partner does get given the visa, especially if theyve refused on a stupid point in the first place.....

Status changed this morning and my husband was sent a text for collection of his documents.

My husband was issued the visa. I am thankful to Allah as all our prayers have paid off.

Timeline:

Visa appl made at LHC: 31.03.2010
Status changed to under process: 12.05.2010
Call to Employer: 18.05.2010
Call to Applicant: 25.05.2010
Visa issed: 26.05.2010
Visa appl picked up: 22.07.2010

If you are over the 12 week mark, make sure you get your MPs involved. This will speed up the long process.

Also, if an ECO does e-mail you, ask them what the decision is, they might tell you.

I will continue to pray and do dua for every other person waiting for a decision. Inshallah keep your faith in Allah.

BTW, I should take some credit (just j/k) as I prepared his Application - I am a Solicitor but not a specialist in Immigration---

now I would have looked a total fool if the Visa hadn't been granted - Immigration is a very specialist area but if you are a Solicitor- everyone thinks you should know everything :roll: and i know nothing lol

So if you are going to make an Application - make sure you hire a really good immigration lawyer like Batleykhan :) Your advice is spot on.

Congratulations to MA786 and your husband, I'm glad the system finally worked with Allah's blessing and your hard work.

I'm writing an email to my MP, who should he speak to as a decsion has been made but we are waiting for the passport and what the decision might be?
I'm still no wiser as what actually is happening between the decsion and getting the passport back.

please help

if i apply again then i know 100% that ECO have stupid reasons to refuse.

i was told before that calling cards were not accepted, and they were used in uk, but the ECO said it were used in pk. such a stupid and unreliabke reason can result in refusal of entry clearance. !!!!!!!!!!!!!!!!!!!!

what a surpprise

however the calling cards clearly displayed the uk city access numbers, birmingham, london, manchester etc etc.


i wonder why does it make them so pleasure in wasting our time, which is priceless :evil: :evil:



we cannot sue any ECO even if it is their mistake?
what can we do if they keep on refusing entry clearance ?

is there any penalties for ECO if they make a mistake?

Were you given any reason why the ECO took so long over your application? And what did they ask when they called the applicant? Is anyone else aware of them contacting the applicant or sponsor? What do they ask?

I pray for for all of us who are waiting that Allah grants us patience and we get a favourable decision quickly.

Aoa everyone

Thanks to C42007, Tasawar, Rhussain07,sf786,rav4u for your well wishes. My husband inshallah is coming on Sunday.

Tasawar bhai, I will do a special dua for you that your wife joins you soon. It is incredibly hard and 3 years is such a long time.

Decisiontime- I just e-mailed my local MP and advised him of the ongoing delay and that a decision had been made on 26.05.2010 etc.

It is only the FCO that can put pressure on the BHC. MP wrote back to me advising that they had sent an email to the mission and my husband received his documents back less than 2 weeks after we had complained.

The delay is uncalled for in my view as my husband's passport was stamped the same day they made the decision on this application 26.05.2010. It has taken more than 40 emails and a complaint to my MP for him to get the documents back.

Corrado and Billo- it is uncommon for them to call the Applicant, however, my husband was previously a working resident in Dubai, UAE and had to travel to Bahrain etc.

He also went to Iran and they wanted to know why he went to Iran for 2 days and what the purpose of his visit was. etc. The call was made to him on 26.05.2010 and the decision was made on the same date.

I think they only call if there are specific reasons for doing so.

I will do dua for everyone else that is waiting. I really pray to Allah that you all get good news soon.
