guys,

i'd like to know what is the success rate for retention of right, please post links (form this forum only) in here, or if you have a story or maybe yourself went through it please post here.

i hear the HO doesnt like the rentention of right process that much is that correct?

Retain the right of residence is the route most of us qualify for PR.You need demonstrate exercise of treaty right by your eea partner and yourself. Go to this link http://www.bailii.org/uk/cases/UKIAT/2010/00003.html

I don't think there is any successful story with regards to retaining rights.
I'm thinking to apply for HSMP if i will be refused.

I was succesfull on Right of Retention of Residency,

When my ex EEA husband started the divorce procedings, we werent best friends anymore, so it took long time to get it the divorce done.
After that I ve sent all my papers, and just a copy of his passport with 3 years of bank statement, divorce decree, letter from accountant, tax receipt, NI receipt, invoices and letter from university.
After 11 months I was granted another 5years.

As my first family permit is finished now in 4/2010, does anybody know if can I apply for a PR now?

I'm about to submit my papers to retain the right of residence. Can som1 plz pm me with a template of the cover letter for HO for this purpose.
I'll keep you updated once i'll send off everything.

yes you can, you just need to prove that since your divorce you have been working/studying/business/self-sufficient. you should them be granted PR.

just out of interest, did you do the retention of rights all by yourself with just a covering letter? i asked around and some solicitors out there are charging £1000 just to apply.

Yeah its ridiculos what they charge isnt it? my solicitor charge me £600.

As I ve applied thought a solicitor so I wouldnt have that letter! Sorry.

hi vegeta,

I ddnt send my docs to HO yet. My ex started new court proceeding due next month to remove my son (who is living in shared custody), permanently from UK jurisdiction.

so I been busy chasing up my lawyer etc. She wants to take away my right to be with Him.

she offerd me that she wl bring hm here twice a year for contact..... :!: but i refused it n now she's gone to court for it.

Just to let everyone who is interested know, that I retained my rights of residence. Application form sent in January 2010 received mid June 2010 (4.5 month waiting). Documents sent to HO: 1. Passport + EEA2 form + covering letter 2. Letter confirming my ex employment for a year before decree absolute is issued. 3. My P60’s + payslips 4. Decree absolute. 5. Bills, bank statements, credit card statements and other docs (both names).

Any questions, please ask…

Congrats Sleeper. do you ,mean you were granted retain right or PR? and if it's retain right, did they issued you with another RC and till when?

It's a new RC for 5 years (same as I had before) + letter confirming that I retained my rights independently.

Alright, but considering the number of year you have already spent with the new RC now, so when are you due for PR?

To Sleeper,

Why you didn't apply using EEA4 instead of of EEA2?
Do you have the right to marry again under the retaining resident or you have to wait until you get your PR?
Would you PM with your solicitor details (it looks like he is a good solicitor)?

Applied with EEA2 as I haven't completed my 5yrs after marriage in this country.
As I understand you can get married, but you can't have any dependents till you'll get yr PR.
I didn't use a solisitor, I've prepered the docs & applied myself.

get a good lawyer my friend and have you tried speaking with her to see reason? but i believe you should make the court understand that you can not live without seeing your child as a father you wish to be in his life.

And just a thought....

This three years rule of being Family member of EU national....

what if the divorce is started before the 3 years are over but divorce is finalised 6 months or 1 year after the 3 years Period....

What would be the options for Family member of EU national.?
