I am a British National and I was working in Ireland for 2 years, then unemployed for 10 months, claiming jobseekers benefit, whilst looking for a job. I have been informed by UK immigration (as part of an EEA family permit application for my wife) that because I was claiming benefit, I was not exercising treaty rights. Is this the case?
