Paper appeal is where the appeals tribunal will look at all the evidence you have submitted on forms and evidence and make their decision. You will not be present and they will let you know of their decision.

A hearing appeal is where you (the sponsor/rep of applicant) and the Home Office rep attend the tribunal in person and the evidence is looked at by a judge and he makes his decision. The difference being that you can also add your own oral evidence and clear up any confusion or points that need clarifying. The Home Office rep can also ask you questions but this can be a good thing, especially if you are well prepared and able to answer his concerns.

I would always advise a full hearing as you have the chance to convey your own evidence and show the judge your merits of the case.

of course a full hearing can take months where as papers take weeks usually, i thought i had gone the best way but waiting for another 6 months was just not going to work(personal reasons)
I hope whatever you decide to do works for you

AIT wont ask for anything further. Actually when you sent in a paper appeal (appeal to be decided on papers), thats it on your part, the next time you will hear from them is when they send you the decision.

You looks right RBJ1597.

I heard they send letter for bundle to send or any addition documents to send.

Oh... just remembered when my cousin go paper appeal, he got a letter to submit more documents.

So it looks I would get a letter for further documents.

Shahzad
the letter asking for a bundle will be addressed to the Respondent who is the ECO, so its for the ECO, BUT its merely copied to you for your records thats why you also receive it in the post.

I did a paper review (unknowingly) and it took 18 months and then got refused. I would advise everyone to go to a tribunal hearing that way you get to put your case in front of the judge.

As per the previous comment, I too would always say that the full tribunal hearing is much better than the paper hearing. In a paper hearing you won't be able to have your personal say in the matter.....all they do on the paper appeal is look at the paperwork you have completed...maybe they don't even bother doing that....at least in the tribunal you KNOW they have reconsidered. Worth the extra wait in my opinion.

you are right but it is expensive..£1000 for oral while paper is free.

Shahzad
£1000 for what?? Are you talking about the solicitors fees? Most straightforward appeals can be done by yourself without a solicitor and you can represent yourself at the hearing. If your case is such that you feel that a paper hearing will cover all points then you definately wouldn't need representation at an oral hearing. You could just do it all yourself. You just sit in front of the judge and tell him why your case is legit and why the home office have got it wrong.

why was the visa refused?

ok let us know how you get on. Still maintain that even by spending money on coming back to the UK just for the hearing would have been better or even getting a friend or relative to go would have been better but good luck nevertheless.
