My visa was to expire on the 4th of August
You need to understand that if your wife has been exercising her treaty rights for 5 years then you gain PR automatically. The HO only confirms this status. You won't be illegal in the UK even if your "visa" is "expired".
they have received my EEA4 on the 11/07. I called them on the 19/07 asking for my passport back
It takes them about 2-3 weeks to actually deal with the post backlog and get you into the system. Once this is done, they issue a CoA (Certificate of Application) and send a letter to you. At that point, it should be relatively easy for them to locate your passport. Also, with the CoA, you should be able to re-enter the UK when you travel in September. I don't think you will get your PR approved by September but if you ask for you passport in one-two weeks time, it should be OK (there is an email address/fax number to contact them for the return of passports).

Husband called HO this morning, my application is at the final stage.
Hopefully it will be done and dusted soon.

well i have send my applicatio on 10 of may .. got coa .. just need passport urgently mid of august.. .. so want to know .. how long they ll take etc etc

I have received the CoA!! They received my application on the 11th July and I have received the letter on the 27th but the letter itself is dated from the 18th July... I can finally order my documents back!

i want to share my unbelievable time scale for permanent residency application.

EEA family permit [ April 2006 valid for 1 year ]
arrived in uk [ June 2006 ]

applied residence card with my EU national wife - October 2006
COA Received Mid October 2006

residence card issued [ January 2007 valid until January 2012 ]
For my wife registration certificate [ January 2007 valid until [ no expiry ]

Complete 5 Years Residency June 2011

Send my Application only First Week of July [ solicitor ] paid £1320.00 solicitor fee.

[ No Certificate Of Application Received ]

Permanent Residency issued 25 July 2011
Received Passport 31 July 2011

Total time period less than 28 days.

[ Upto 50% Original documents missing dont know home office missed placed or my solicitor. anyway dont need them anymore. ]

May I ask why you used a solicitor? Seems a lot to pay for a free application.

good question. actually my this solicitor dealing with my case from day 1.
First family permit then residence card and now permanent residency. i know the money i paid is a lot. but as i said before [dealing from day 1] thats the only reason i use solicitor.

Why do I get the feeling that the Home Office is in some way accepting money from solicitors to give a priority service?

Here is my EEA4 time scale so far:

EEA3+4 applications sent on 13 July 2011
Recieved by Home Office 14 July 2011
COA dated 22 July 2011
COA recieved by 2nd class 5 August 2011

Now waiting for PR

Its just a generic letter with my name and correspondance address on top. It is signed by "Data Proc Tm Liverpool 1" and it includes all the generic info: Not to make non-urgent travel, permitted to take offers of employment, DO NOT telephone or make enquiries.

It also says: If you need to contact us by telephone to urgently request passport or documents back please USE THE NUMBER ON THIS LETTER.

The funy thing about contact info on the letter is:

Tel (left out blank)
Fax (left out blank)
Email (left out blank)
Web www.ukba.homeoffice.gov.uk

I guess they REALLY don't want me to call them :D

We called to request out documents back. But I am not sure if I would have the stamp in my passport. We will find out tomorrow. Going to stay at home tomorrow just to learn the result asap!

All in all, the whole process took 6 weeks :D I wasn't expecting to receive my passport back until sometime in late October or early November going by other people's experience in this forum, but I guess my application was pretty straightforward. I didn't use a solicitor, just submitted everything myself. Good look everyone who's going through the process.

i am married to an eea national fr lst 3 yrs, have visa till 2016.
I will complete my 10 yrs lawful residence in UK by august. Can I apply fr EEA4 then?

No you can apply after being married to the EEA National for 5 years. When you get an EEA FP your clock resets and your timescale begins from the date of marriage

i can apply fr long residence as per 2.3.8
I am not sure, whether i can apply fr ILR or not, this is why i asked in this forum

Thanks really impressive. Please can you advice what documents have you sent in order to get so quick response. It really helps people like me as i need to apply in November this year and my case is also straight forward. i.e. Wife working more than 5 year with same employer, living in the same address for 5 years etc. I want to get advice from your experience. Would be appreciated.

Hi all.

I sent an application for EEA3 and EEA4 together. Here's what happened so far:

17/08/11 - Sent EEA3 + EEA4 to Home Office (1.3kg of documents - I included a special delivery return envelope w/ extra postage to support the weight)

09/09/11 - I called the UKBA to enquire as to why I hadn't yet received any Certificate of Application. I (non-EEA national) explained my employer was looking for it. They said they'd send an enquiry to the appropriate team.

16/09/11 - I received the Certificate of Application for EEA4 (dated 09/09/11!). My partner also received their passport and document confirming permanent residence (EEA3) ! Interestingly, all documents were sent by recorded delivery (not using the prepaid envelope I supplied which I hope they'll use for my passport)

So, point is - EEA3 received in 1 month!

EEA4 still pending... I really hope mine will be coming very soon! Given that they've confirmed my partner has PR and we have been clearly married more than 5 years, it should be very straightforward....... So I think!
