if thats the reason then i think they will definitely overturn the refusal from embassy. i dnt think ur case will go for hearing.

Hello friends

today i received a letter from tribunal saying that my appeal has been withdrawn by the respondent (i.e ECO). Does that mean that ECM has overturned the original decision? I assume so but on the other hand my wife hasn't received any letter from BHC Mumbai asking to submit the passport for stamping yet. The letter i received from tribunal is dated 11th August.

Yes i think your desicion has been overturned... Congrats... U should get a call latter in a day or two...

BTW wat was ur reason for refusal?

Reason was that they are not satisfied that we have a subsisting relationship at the time of application or our relation is genuine.
I m starting to get excited slowly now...

Dnt worry bro... U will get call latter soon... After reading your comments me too feeling bit possitive as i lodged my appeal after 10 days of urs... I should hear from them soon... I havent recieved any latter from tribunal yet though abt deadline date for ECM

my wife received a courier today from BHC Mumbai in which she got our photos and marriage invitation card that we sent with appeal but we havn't received any other documents that we sent to them with appeal form. And also there is no other letter in the courier either informing us about anything. Does anyone there who came across similar situation before.

She's going to ring BDHS tomorrow anyway but just in case any one knows anything.

hi ejaz there is no more need to ring them as my wife received another letter asking to submit the passport at Mumbai BHC.

ECM overturned the decision finally. the hard time is over now. WOOO!!!

Here is my time frame :
Appeal lodged : 11th July
Ack. Letter : 26 July (Dated 15th July)
IA10 from Tribunal : 12th August ( Dated 10th August)
Decesion overturn letter : 17th August ( Dated 9th August)

U should be getting letter soon i think.

Hi in the letter they have asked to submit passport at Mumbai. Do you know if i can submit it at my local VFS which is Ahmedabad?
How long does it take to get the passport back?

Hello, kalpitgopi and Ejaz: I would like to know that when we apply for appeal, how long after we received acknowledgement letter? Kalpitgopi, In your case, did u get any acknowldgment letter or did you get call letter directly? please tell me thanks. (Appeal process is same, no matter which country you from)...So i want to know if you got acknowldgment letter then does it mention anywhere by tribunal giving time line to ECO to overturn his decision or going for hearing?

Yes i lodged my appeal on 21st July and got acknowledgement latter on 10th August (Dated 2nd August). Now waiting for call latter. hopefully it should come by next week as kalpitgopi got it 2 days ago.. he lodged 10 days before me at mumbai...

Thanks Ejaz 12: I would like to know that the acknowledgement letter you received mention any deadline given to ECO from Tribunal to either overturn his decision or get ready for hearing if he does not withdraw. One of the member got acknowledgement letter on 8th of August stating a deadline of 16 December giving time to ECO to respond back if he does not withdraw then court start hearing after 16 December. Which means that appeal is going to take longer for that member. So i am just worried and want to know that everybody gets acknowledgement letter in same way? What about you Ejaz and kalpitgopi? I hope you understand my question. How many Objections have you got? As i got only one objection. And i want the appeal process should end soon.

yes i did receive acknowledgement letter stating the deadline for ECM review which was 5th september but on the next day my wife received call letter. I had only one objection which was that they were not satisfied that our relationship is genuine. Luckily i went for an appeal with additional docs and ECM overturned the decision within 28 working days.

And hi ejaj..any updates in ur case??? My wife submitted the passport at mumbai on 22nd August and now we are waiting for passport to come back.

That's great kalpitgopi, I got only one objection as well which is they are not satisfied that our marriage is a registered marriage under immigration paragraph 82 (1). I submit evidences ( Government stamp and letter stating marriage is registered etc). I hope ECM should overturn his decision soon same like yours. Thanks for your reply.

Got my passport stamped with visa today!!! Everything was proper on visa.
Submitted my passport: 10th Aug
Received my passport: 6th Sep by Registered post

Took almost a month!!

You originally got rejected because they did not believe the relationship was subsisting / genuine.

Can you tell me what docs you submitted in your original application in regards to communication? phone billls / emails / skype / msn etc

I will submit soon and want to ensure I dont get refused for the same reason, thanks!
