If deported from UK - when able to return.

Anyone know for sure how long someone who has been deported from the UK has to stay away. Is it indefinitely or can they return with no problem after so many years.

3 years automatic bar, then depends on circumstances. Also depends on the reasons why deportation order was made. It might be that the return of the person to the UK will not be conducive to the public good, which means an eternal bar.

Deportation is of indefinite duration unless revoked by the Home Secretary under sec 5(2) of the 1971 Act. It is possible to request for the Home Secretary to consider such after a 3 year period has elapsed. Even where the deportation order is revoked the applicant must still meet the relevant immigration rules in the category he/she seeks leave to enter. However given that deportation is usually on serious criminality it is rare for such '3 year post deportation' requests to be considered let alone see the light of day.

Yes, this is now but what about 6 years ago when other categories including overstays were liable for deportation?

Jeff,

Hence note my caveat 'usually' 8) . The Home Office recognised this misnomer hence the introduction of 'removal' into the Acts/ Rules albeit removing some legal redress from those 'removed' as opposed to those 'deported'. Deportation remains a powerful tool in immigration policy for any country.
