Old Work Permit Holders ILR

Hi All,

I am making application ILR, End of October and would appreciate advice from immigration expert on this forum.

I am on work permit issue in 20th October 2006,

28th November 2006 – 28th November 2011 (Passport Stamp)
Type of Visa: Work Permit
1st work permit was issue on £16,000 per annum

20th March 2007 – 20th March 2012
Type of Visa: Work Permit
Current Job title: Production Engineer.
2nd Work Permit was issued on £19,500 per annum

Hence, I believe I would be eligible to make the application for ILR last week of October.

I fulfil all the requirement ILR except one (New income requirement which is introduce on 6th April 2011) which is stated below

My Job title: Production Engineer (code of practice Section C Manufacturing (2127) Production Engineer required rate £12.78 per hour hence as per my contract 35 hours per week I should be earning £23,259.00 but I am only earning £20,300.00)

Has anyone made the application of ILR with above situation and have received any outcome?

As speaking to various solicitors and email to UKBA recommended that Old work permit holder do not have to meet the new income criteria as far as they show they are earning at or above income which was stated in there work permit application.

Please need more comments !!!!!!!

What was the salary stated in your current (2nd) work permit?

If your current earning is not less than that, then you might be ok...

you have to be paid at or above the SOC code. other wise will be rejected.

If you just apply like this, you'll definitely be rejected.
1, try ask for payrise
2, find another SOC code whose job description is close to what you actually do, after all "Production Engineer" covers a lot of area. The job title doesn't necessarily have to be word for word, what you actually do is more important.

Hello,
I have just got a refusal letter today from HO!! They refused me under the COP rules. i am an old work permit holder.
I have got work permit on 18th of june 2008 as a hotel manager and the salary was £19k (45 hours pw).
But under the COP on my position it says, I have to earn £19k (39 hours pw)!!
as i believe HO made this rules on March 2011.
On my last p60 (which i did submit on HO) was £19,700
My question is, why they applying the new rules on me and what should I do now?
I have a right to apeal by 18th of February.
I need all of your advice please. Any referance will be much appreciated.
