Hello vndpag
I agree with you that there is no chronological order for the issue of RC. Its like a "Bell Curve" few people will be at both sizes where it narrows to the X axis. ie people like Cuteson who will have theirs very early and other people who will have theirs very close to or beyond the six months period but I think majority are being decided within the 3-4.5 months range.

Good luck to everyone waiting.

-------------------------------------
16/07/11 - EEA1 and EEA2 sent to EEA2 postal address
18/07/11 - Royal Mail confirm delivery
10/08/11 - COA and EEA1 both approved
02/09/11 - COA and EEA1 stuff received in 1 pack
XX/XX/XX - Awaiting RC.

Overstayer allowed to work??

Post by Ikonkar » Tue Oct 18, 2011 1:02 pm

First of all a Big Thank you to all the moderators creating this such a wonderful website, I have been frequently visiting this website and gaining a potential knowledge about all sorts of immigration advice people give out. So a big Thank you to all of you.

Now here's my questions.

I'm from a non-eu country and have been residing in England for the past 7 years and illegal or overstayer you can say for the past 3 years. Recently(1st week of Oct) I got married to an EEA national ( a true and a genuine marriage) been together for over an year. I just want to clarify that am I allowed or eligible to work prior to applying for an EEA2 application. I know I can work once I receive COA, but was just wondering if it's OK for me to continue working. I understand it will be hard to prove it to my employer, saying that I'm already employed by a reputed company(but they don't know anything about my immigration history). Now I'm married I dont think there should be any problem if they do turn around and ask me( in near future). Also my passport expired at the beginning of this year and just waiting for my embassy to re-issue my passport so that I can apply for an EEA2 permit.

I hope for your best replies.

Thanks

As long as your wife is exercising treaty rights in the UK, you are legal and allowed to work (although as you said would be difficult to prove until receiving the confirmation from HO).

Hi billy0788 sorry to hear that your waiting for your RC quite long time I understood your side frustration I advice you to call home office about application and request COA. I believe your solicitor should know that COA should issue to applicant within six weeks of submission. As long as your legally married and your partner exercise treaty right as worker, student, or self sufficient you don't have to worry just need to chase up.

Please if you don't mind could you give some more detail about yourself and your partner, it is not necessary but at least people can assess your case and can give advice on this forum. Wish you all the best and keep posting your query and information with us.Thank you

Point of correction: Once you are married to eu ? You are no long overstayer or illegal.

Once you have been issue COA letter. I believe 95% of companies knows about it and if they want more information? They will contact home office. You don't have to worry about it.

Get your passport sort out and apply faster. I guess you know how people waiting RC.

When sending your application? You can add pictures. I mean your wedding pictures. And some event you went with your wife in pass few months.

Again! you don't need LAYWER at all.

Thanks

Firstly you shoudn't use solicitor at all. They waste people time and they didn't do anything to help you.

You paid him/her money to help you sort the application. But now you are worried alone.

If your wedding is real you don't have to be scared to call home office concerning your application.

(1) Your wife is working?

(2)You need to comfirm if truely your solicitor sent the application.

Your solicitor should give you more information about it.
