Sharing

Post by Innersource » Wed Oct 19, 2011 6:07 pm

Since I found this topic in April I've been following it daily, It feels so good to know that people out there are sharing the same feelings I feel and that's why I decided to speak out cause I truly believe that any concern, feelings, doubt that we suppress we actually keep them alive within , so I am sharing my story which is similar to most of the stories I've been following, except that it is mine.

My story started on the 31 of April 2011 when I went to a solicitor to explain my situation. (I'll make this short as I have said a lot already.) I came to London in 2007 on a tourist visa, overstayed all this time as haven't left the country since then. My solicitor sent my application for COA (Certificate of Approval) on the 5th of April , one day after COA scheme was abolished. After that date anyone could go to a registrar office and make an appointment to get married, but it wasn't easy for me as my passport was sent to the HO and as my situation was stated as an over stayer my passport was retained , anyway after struggling with the registrar officer I could make an appointment to get married without my passport, and I entered a civil partnership on the 6th of June 2011.

13/07/2011 eea2 was sent to HO
15/07/2011 eea2 was received by HO
08/08/2011 COA received dated 25/07/2011
RC: ?????? hopefully soon...

My partner is German exercising UK treaty as a self-employed.
Thanks everybody for sharing their experiences I've been uplifted and it has brought me some comfort and hope. All the best ....

Hi Innersource ! thank you for sharing your story with us and good to see people come out with their story rather then just simply looking at forum and reading and not communicating with anyone. This is all about gathering information and sharing each other so at least we can relive mental stress and can patiently wait for RC looking at similar cases in this forum.Once again thank you very much and keep post your query and information and good luck to everyone whose waiting for their RC

I appreciate this thread is specifically for timelines and related COA and RC delay queries. But I just want to emphasise on the need and to encourage the viewing guests to share their experiences in particular their timelines.

Registration is very simple and takes no time at all and its free; thanks to the Founders and moderators.

No one can have a proper assessment or predict any expectations until there are a lot to compare with. If everyone expects someone to do it then no one will do it.

There are almost 90% more guests looking at this forum at anytime than registered members. I am therefore pleading with all guests who are waiting to get their RCs to register and post their experiences and timelines.

My wife and I re-applied for EEA1&2 on the 1st September. I am a non EU national. Up till now no COA has been sent out to us. I called HO on 27th sept as my employer asked me for my passport due to my visa which expired in July. I told employer I just applied to the HO but I can't prove this. HO told me to call again after 10 working days and I told my employer this. My employer sent out an employee checking document on the 5th of this month and last week I was told by my employer that HO said I don't have any COA. I have called HO again on the 11th,18th and 20th of this month and yet they keep telling me different stories that HO is not within any time frame to issue a COA. My wife got her EEA1 on the 10th of this month dated back to 27/09/11. I really don't know what to do now as I keep getting different responses each time I call them. Pls advise me what to do.

STUDENT VISA

Post by vallmontt » Fri Oct 21, 2011 2:19 pm

Hi everybody,

I am in the Uk since Feb2011 as a student and got married with my 7 year partner in May2011.

I've applied for my EEA2 on Sep 5th and they told me today that I will receive my COA in 5 days.

My query is, I have my student visa until March2012, do I still need to go to school after receiving my COA? They are sending me some emails saying that if I don't go they will be reporting it to the Bordr Agency and I can be removed from the Uk.

Can anyone help me with this?

Many thanks.

Once you get married to an EU citizen, you are definitely covered by the related EU immigration rights and responsibilities. If you get the COA, it is most likely to give you the right to work and reside in the UK until your case is decided. During this period and so far us your EU partner is exercising the EU treaty rights you will have the right to work and reside, which in theory immune you from deportation.

You have to weigh if you want to play by the Student visa rules until you finally get your RC or rely 100% on your right by the virtue of your marriage. But as I have said you are immune from deportation if you are married to an EU citizen and the person is exercising the treaty right.

Good luck.

anyone picking it up usually must provide an ID card (with my local post office, debit card with printed name is ok and even a letter with name and address), so you can have your husband try picking it up with the "while you were out card" + a bank statement addressed to you and a debit/credit card in your name. Should be ok, to be honest, unless you are unlucky enough to get some busy body at the post office doing it by the book. Equally, have a female friend go through the process with the paperwork and debit/credit card, there would be fewer questions.
