Old WP and Tier 1 - do new rules apply?

Post by shimu » Tue Dec 27, 2011 7:42 pm

My husband has been in UK for 5 yrs now. Initial two years were on WP and then onwards tier1. After reading this article http://www.freemovement.org.uk/2011/11/ ... t-holders/ I am in doubt now.

1. Does this apply to his case ? We he also have to show that as work permit holder he was paid a certain salary according to SOC code ?

2. For this do we need to get letter from employer to confirm soc code or salary or anything ?

pls help. thanks

further Qs

Post by shimu » Thu Dec 29, 2011 12:25 pm

I have further questions . Please help.

My husband is eligible for ILR at end of Jan 2012. Suppose he applies and is granted ILR. I am on ILR dependent visa but I have not completed 2 yrs ,so I am not eligible for ILR. My dependnt visa is valid until 4 april 2012. I have travel plans to India from 16 feb to 25 Feb.

1. If, I dont apply for FLR (M) before I leave UK on 16th Feb - will there be a problem in entering UK on 25th Feb ? Can the immigration officers deny me entry on dependent (tier1) on the 25th ?

2. I dont want to apply for FLR (M) before I leave because I think it will take time for BRP to comeback to my UK address. If, I dont get it by that time I leave UK on 16th feb then my reentry to uk could be a problem. Is my understanding correct ?

thanks for your response
regards
