EEA4 processing time.

Hi all, I have EEA national spouse, been together since January 2007 but married on November 2008 and received my Residence Card(5 years visa) on July 2009. Recently I spoken to a few different staff of HO and they said I don't have to wait for my RC to expire I'm automatically permanent and can apply for PR if I want to.
Have you guys heard anything like that as I have also seen this on the HO website.
I have applied for PR on Friday 24/02/2012 and today has received by HO.

I'm surprised that the HO has advised you that you already have PR status.

Assuming you have been living all this time in the UK, you will obtain a PR on the 5th anniversary of your marriage (assuming it was in the UK) or from the time you entered the UK as a married person.

The HO might recognise your time before the marriage but it is not very common for them to do so.

I suspect your PR application will get rejected as you haven't completed 5 years under the EEA regulations.

you should be able to get if you can proof on that time you were living together.

I got rejected in Nov 2010 (applied in June 2010).
Decided to appeal in January.
Got the hearing notice letter in Feb for the paper hearing taking place in sometime Feb 2011.
A week after the paper hearing, I got the letter saying my appeal was successful.
April time I got the 10 year PR in my passport (but had to fax the homeoffice to chase for the visa issue).

Basically the whole story is I have been living with my husband for 5 years but only married for 3.5 years. The judge allowed the appeal, it seemed like a straight forward case for him.

I confirmed with HO that I have only married with my EEA spouse for 3 years but been living together in UK for 5 years and 1 month(with proves) and my spouse been treaty exercising through out 5 years.
HO replied that it count from the day we lived together as a family, regardless marriage as some couples don't even get married but still are a family.
So yes it's clear on HO website.
