Need Clarification. Plz Help

Following the High Court Judgment of 8 April 2008, migrants who obtained leave to enter or remain based on a letter of approval issued under the HSMP criteria in place before the programme was suspended on 7 November 2006 should be considered against the extension criteria in place when they joined the programme
Can some Senior Plz explain this?

This means whether HSMP approval letter must be issued before Nov 07, 06

or

Home Office Acknowledgement received before Nov 07, 2006

it means when you applied and sent your application first time successfully for HSMP ,the date of your application sent to ukba by post.

We applied/ sent our application in Sept 2006 but unfortunately it was not successful first time , we went for first review and then second review.

HO sent us acknowledgement in the month of Nov 2006 before Nov 7, 2006 for our first application we sent in September 2006.

So where we stand ? :( :( :(

could you please explain your question,than we shall be able to help and discuss.

in my opinion,your date of application shall be the date when you sent and post application to HO.it doesn't matter if it wasn't successful first time until your application was completely refused and no visa issued.as you went for review twice ,and at the end HSMP visa was granted,so your date of application shall be the date when you sent application first time.

Intial HSMP application filed on September, 2006 ( HO Acknowkedgement
dated November 02, 2006) we have a copy of that

Refusal of HSMP Application Dec-06
Applied for Review through consultant
Refusal of HSMP Review Apr-07
Sent another application for Review Jun-07
HSMP Approval Letter 13-Jul-07 based on the application received by
HO on September 2006
Applied for EC Oct-07
EC Refused Nov-07
Appealed Dec-07
Applied for EC Dec-09
Reprint of HSMP Letter Feb-10
Isuued Visa Mar-10 for three years and its written HIGHLY SKILLED MIGRANT VISA.

Above is our timeline , hopefully now some one can explain

in both case,your date of application is before 7th November 2006,as described and specified in this link ,

you applied in September 2006 under HSMP programme and received acknowledgement letter on 2 November 2006,your current extension shall be under HSMP rules and regulation in place at the time of application. don't worry about that.

I want you to check and confirm following things from the link

1.that your date of application is one when you applied first time by post
2.you are under HSMP,so you shall be covered by those rules and regulations in place before 29th Feb 2008 for HSMP..
3.when you shall apply for extension,enter the date 29th February 2008 in points calculator

one of my friend had approval letter before 29th February 2008,he applied for visa extension in may 2011 under old hsmp rules and regulations and got extension successfully.

there is noting to confuse if u have filed application before sept 2006 , u r covered by jr review
