Dear members need help (salary period)...

Dear members,

I am writing this query on behalf of one of mine close friend.

He got tier 1 general visa which is valid until 29/10/2012 and his extension is due in near future.

If he able to get same day service on 02/10/2012 at PEO for his extension then which 12 months he can claim the wages points?

He gets wage on 27th of every month.

Can he claim the wages for 12 months from 27/07/2011 to 27/06/2012?

Your advice will be highly appreciated.

he could be fine depending on how you look at it. Regardless of which date he gets his salary paid, I assume he is paid on a monthly basis, i.e. he gets paid on 27th March for 1st to 31st of March. If this is the case, he can claim salary for period 1st July 2011 to 30th June 2012 (which will be a 12 month period in the last 15 months) if he is applying on 2nd October 2012. Hope this make sense.

Seniors please correct me if I am wrong.

I am assuming there must be a valid reason your friend wants to consider the pay till 27/06/2012 only.
Considering the above details.
The immediate 15 month period between which you are able to choose the 12 month period, will expire on 27/09/2012 or 30/09/2012 if considering month end (assuming you are considering the payslip/wages your friend receives on 27/07/2011). Check point 79, which states
The applicant can claim points for previous earnings in any single, consecutive 12-month period during the 15 months immediately before the date of applying.

So either your friend will have to skip the wages received on the 27/07/2011 or book a PEO appointment earlier if he wants to show his pay only till 27/06/2012

Assuming he is applying by PEO on 2 october, He can claim points from 2 july 2011

Now he can claim any consecutive period between 2 july 2011 and 2 october 2012. If you earned sufficient points in less than 12 months he can claim only that period. If he earned 100000 pounds in a month just claim that month only:-).

The 15 month period immediately preceeding his application date starts from 02/July/2011. Therefore he should be able to claim points based on his salary for the period OP has mentioned.

He /she can apply whenever they want. UKBA suggests that the application is made not earlier than 5 weeks of visa expiry but there are no definitive timelines. He / she can apply even 1 year in advance but the only issue is he / she might fall short for ILR.

Best bet, go for same day service within 42 to 0 days of visa expiry.
